FARLEY AND BOARD OF TRUSTEES FROM: VILLAGE MANAGER DATE: OCTOBER 14, 2004 CHARITABLE DONATIONS TO THE VILLAGE SUBJECT: Earlier this year, the Village considered the need to establish a Charitable Foundation in order to receive cash and other donations made to the Village for either specific or general purposes. After research by the Village Attorney, it was determined that donations directly to the Village enjoy tax deductible treatment based on the Village's status as a Municipal Corporation. Certain Village authorized Boards and Commissions, specifically the Special Events Commission and the Sister Cities Commission, were given the specific authority to solicit donations in furtherance of their respective missions. It was further suggested that there be a general provision contained in the Village Code that covered general donations to the Village that may occur from time-to-time. This Code Section would provide general guidelines for the review and acceptance or rejection of a specific donation. Under the proposed language, the Village Manager would make an initial review of the donation in terms of its suitability and then make a recommendation to the Village Board who would then officially accept or reject the donation. Staff believes the proposed Ordinance meets the needs of the Village in this regard. A recommendation is forwarded that the Ordinance be adopted as proposed. -----~' "---~ MICHA L . Hill, Jr. b ORDINANCE NO. - AN ORDINANCE AMENDING CHAPTER 8, ARTICLE V OF THE THE VILLAGE CODE OF MOUNT PROSPECT BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION 1: A new Section 8.518, entitled "Donations," shaH be inserted into Article V, Chapter 8, of the Mount Prospect Village Code to be and read as follows: DONA TIONS TO THE VILLAGE: Whenever a donation is offered to the Village, the ViHage Manager shall review the overall suitability of the donation, including any maintenance or other costs associated with the donation, and make a recommendation of acceptance or rejection to the President and Board of Trustees. For purposes of this section, "Donation" shaH mean any gift, whether of cash, service, product or other "in-kind" offer. Upon approval of an offer of donation by the President and Board of Trustees, the donation shall be used for the express public purpose of the offer. If a public purpose is not expressed at the time of the offer, the donation shall be used for such public purpose as the President and Board of Trustees may designate. The foregoing shall not apply to any Commission or Committee otherwise specifically authorized to accept donations under the Village Code. SECTION 2: That this Ordinance shall be in fun force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law. Our present condominium conversion ordinance requires buildings under going a condominium conversion to install automatic fire sprinklers in accordance with NFPA 13, Standard for the Installation of Automatic Sprinklers. This sprinkler standard requires sprinklers in all areas of the building including bathrooms, closets, unheated areas such as attics and exterior walkways. The intent of this standard is to provide a higher degree of life safety and property protection by installing sprinklers in all areas of the building. Where property protection is a primary objective, a stronger water supply is needed that equates to larger sprinkler piping. In existing buildings such as apartments, the cost to retrofit sprinklers in all areas of the building can be very expensive. The fire department has evaluated other levels of cost effective fire protection without loss of occupant protection. The intent of our evaluation was to determine a level of cost effective fire protection that would provide the greatest level of safety to the occupants and not financially hinder the condominium conversion process. The primary goal of the required fire protection would be for life safety with property protection as a secondary goal. Another aspect of the evaluation entailed the need to address fire protection for the variety of potential future condominium conversions and the uniqueness of these building's construction features. After considerable evaluation, the fire department is recommending the attached ordinance that would permit buildings undergoing a condominium conversion to install sprinklers in accordance with NFPA 13R Standard for the Installation of Sprinkler Systems in Residential Occupancies. NFPA 13R provides a cost advantage with respect to providing life safety protection in low-rise residential buildings such as condominiums. This is a less restrictive sprinkler code and would allow the omission of \\fd 1 \Users\pvalenti\Main\MISC\Condoconversionmemo 10804. doc .n ~ sprinklers in unheated areas such as attics, bathrooms, and closets (24 square feet). Elimination of sprinklers in these areas results in a reduced level of property protection but still focuses on the primary goal of life safety. Since the primary focus of the sprinkler design is on life safety and not property protection, the water supply requirements are drastically reduced. This allows for smaller piping that results in a substantial cost saving. The proposed ordinance would only permit a 13R type of sprinkler system under the following conditions: 1. The condominium units have a direct exit to the outside or 2. The building is three stories or less and the fire chief has determined there are no construction features of the building that in the event of a fire pose a threat to the safety of fire fighters. The buildings will be required to have a fire alarm system to alert the occupants and 120-volt smoke detectors in each of the living units as well. This component is necessary to help achieve our goal of providing a cost effective level of life safety protection. The fire department believes that the proposed ordinance addresses the need to provide a cost effective level of fire protection with the primary goal as life safety. The proposed ordinance also provides the fire chief the latitude to review each condominium conversion to ensure the building's unique construction features do not pose a significant hazard to fire fighters or building occupants in the event of a fire. In these situations, the more restrictive sprinkler requirements would be required. The attached table compares our existing fire code requirements to our proposed changes. The table also illustrates the changes of our proposed code requirements for condominiums. ORDINANCE NO. - AN ORDINANCE AMENDING CHAPTER 23, ARTICLE XVI OF THE THE VILLAGE CODE OF MOUNT PROSPECT BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION 1: Section 23.1603, entitled "Definitions," of Article XVI, Chapter 23, of the Mount Prospect Village Code shaH be amended by adding the foHowing definitions in their proper alphabetical place within the Section: CONVERSION BUILDING: Any structure in a condominium conversion project. CONDOMINIUM CONVERSION PROJECT: The property which is being converted into condominiums from that which is or has been whol1y or partiaHy occupied before the recording of condominium instruments by persons other than those who have contracted for the purchase of condominiums. SECTION 2: Section 23.1612, entitled "Condominium Conversions - Occupancy Certificates, Inspections and Fees," of Article XVI, Chapter 23, of the Mount Prospect Village Code shal1 be deleted in its entirety, and a new Section 23.1612 inserted in lieu thereof, entitled "Condominium Conversions - Occupancy Certificates, Inspections and Fees," to be and read as follows: 23.1612: CONDOMINIUM CONVERSIONS - OCCUPANCY CERTIFICATES, INSPECTIONS AND FEES: A. No unit in a conversion building shall be occupied unless and until an occupancy certificate has been issued for such unit by the director of community development. B. Before an occupancy certificate may be issued for a unit, such unit and the common areas of the conversion building must be inspected by the viJIage for compliance with applicable vil1age ordinances. No occupancy certificate shall be issued by the village for any unit unless and until the ¡Manage 1383702 C. ¡Manage 138370 2 common areas of the conversion building and unit are in compliance with applicable viIJage ordinances. A conversion building shall be protected throughout with an automatic sprinkler system installed and maintained fuIJy operational, in compliance with sections 24.202(C) through 24.202(0) of this code, and NFP A 13, Standard for the Installation of Automatic Sprinklers, subject to the folJowing exceptions: 1. Conversion buildings, which have code-compliant exits leading from every condominium unit directly to the outside of the conversion building and to the public way, may comply with the sprinkler system design and instaIJation requirements of NFP A 13R, in lieu of NFPA 13. 2. Conversion buildings, which have three (3) stories or less, may comply with the sprinkler system design and installation requirements of NFPA 13R, in lieu of NFPA 13, upon written approval of the Fire Chief. Said approval shall be based upon the Fire Chief's opinion that the construction features of the existing conversion building do not create a significant hazard to fire fighters or conversion building occupants in the event of a fire. D. In conversion buildings, which have three (3) stories or more, standpipes shall be installed and maintained fully operational, in accordance with section 24.203 of this code, except that the less restrictive standpipe design requirements in section 24.203(f) of this code may be utilized in three (3) story conversion buildings. E. An automatic fire alarm system shall be installed and maintained fully operational in conversion buildings, which have three (3) stories or less. Said system shall consist of the following: 1. Audiovisual devices and manual pull stations in all common areas of the conversion building in accordance with NFP A 72. The audio devices shall be sufficient to alert occupants in each unit. a. Exception: Conversion buildings, which have code- compliant exits leading from every condominium unit directly to the outside of the conversion building and to the public way, are not required to install and maintain audiovisual devices and manual pull stations in all common areas. 2. Hardwired smoke detectors in each unit in accordance with section 24.204(3) of this code. 3. Fire alann systems shall be monitored as provided in Section 24.204(A)(4) of this code. F. In conversion buildings, which have four (4) stories or more, fire alann systems shall be installed and maintained fully operational, in accordance with section 24.204(A)(5) of this code. G. Conversion buildings shall have adequate driveways for access by the fire department, as deemed appropriate by the Fire Chief. H. Conversion buildings shall comply with the fire prevention code, as set forth in Chapter 24 of this code. In the event that any provision of this section conflicts with the fire prevention code, the provision of this section shall govern. 1. The fees for inspection of a condominium conversion project shall be as follows: 1. The fee for inspection of the common areas of a condominium conversion project is set forth in appendix A, division II of this code. Said fee shall apply to groups of ten (10) or fewer condominium units within a condominium conversion project, and shall be payable on or before the date upon which the common areas of the conversion condominium project are inspected by the village. 2. The fee for the inspection of individual units of a condominium conversion project is set forth in appendix a, division II of this code, and shall be payable on or before the date upon which each such unit is inspected by the village. 1. The developer of a conversion condominium project shall aITange the dates and times for the inspections required by this section with the director of community development. SECTION 3: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
