DRAFT MINUTES 10/05/04 CALL TO ORDER ROLL CALL PLEDGE INVOCATION MINUTES BILLS MA VOR'S REPORT MINUTES OF THE REGULAR MEETING OF THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT October 5, 2004 CALL TO ORDER Mayor Gerald Farley called the meeting to order at 7:04 pm. ROLL CALL Present: Trustee Timothy Corcoran (late arrival) Trustee Paul Hoefert Trustee Richard Lohrstorfer Trustee Michaele Skowron Trustee Irvana Wilks Trustee Michael Zadel Mayor Gerald Farley PLEDGE OF ALLEGIANCE Trustee Hoefert led the Pledge of Allegiance. Trustee Corcoran arrived at this time. INVOCATION Trustee Zadel gave the invocation. APPROVAL OF MINUTES Trustee Wilks, seconded by Trustee Skowron, moved to approve the minutes of the regular meeting held September 21, 2004. Upon roll call: Ayes: Corcoran, Hoefert, Skowron, Wilks Nays: None Abstain: Lohrstorfer, Zadel Motion carried. APPROVE BILLS Mayor Farley stated that the next item on the agenda, "APPROVE BILLS" noted by an asterisk, and all other items listed in that manner, would be considered with one vote, as business item "IX. CONSENT AGENDA" MAYOR'S REPORT Mayor Farley presented a proclamation to Joan Wilkins, Holmes Junior High Choir Director, recognizing October as National Arts and Humanities Month, and the Holmes Junior High Show Choir entertained the audience with songs and creative dances, in keeping with the theme of National Arts and Humanities Month. Mayor Farley presented proclamations acknowledging October as Domestic Violence Awareness Month and in recognition of Make a Difference Day, October 23. Fire Chief Michael Figolah was presented with a proclamation acknowledging Fire Prevention Week, October 3-9. Chief Figolah encouraged everyone to test their smoke alarms and practice fire safety. WU SUNG RESTAURANT, 1747-49 ALGONQUIN RD. AMEND CH. 13, RUFINI'S RESTAURANT, 2 W. BUSSE AVE. ORD. 5462 EMPLOYEE RECOGNITION The Board received a request from the new owner of Wu Sung Restaurant, 1747-49 W. Algonquin Road, to continue operating under the existing Class R (consumption at dining tables only) liquor license. Trustee Corcoran, seconded by Trustee Zadel, moved to approve the petitioner's request for a change of liquor license ownership. Upon roll call: Ayes: Corcoran, Hoefert, Lohrstorfer, Skowron, Wilks, Zadel Nays: None Motion carried. An ordinance was presented to amend Chapter 13 (Liquor) of the Village Code by deleting the number of Class W (beer and wine only) liquor licenses by one, and increasing the number of Class R (consumption at dining tables only) licenses by one for Rufini's Italian Restaurant, 2 West Busse Avenue. Trustee Corcoran, seconded by Trustee Zadel, moved to waive the rule requiring two readings of an ordinance. Upon roll call: Ayes: Corcoran, Hoefert, Lohrstorfer, Skowron, Wilks, Zadel Nays: None Motion carried. Trustee Corcoran, seconded by Trustee Zadel, moved to approve Ordinance No. 5462: AN ORDINANCE AMENDING CHAPTER 13 (ALCOHOLIC LIQUORS) OF THE VILLAGE CODE OF MOUNT PROSPECT Upon roll call: Ayes: Corcoran, Hoefert, Lohrstorfer, Skowron, Wilks, Zadel Nays: None Motion carried. The following employees from the Police Department are celebrating quinquennial anniversaries with the Village. HOLIDAY LIGHTING, ARBOR GREEN, LTD. LEGAL COUNSEL FOR BOFPC OLD BUSINESS AMEND CH. 18, HIGHLAND STREET Mayor Farley had no recommendations for board/commission appointments. COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD None. CONSENT AGENDA Trustee Corcoran, seconded by Trustee Skowron, moved to approve the following business items: 1. Bills, dated September 16-29, 2004 2. Request for Board approval and acceptance of public improvements at 420 Kingston Court Bid results for holiday tree lighting contract with Arbor Green, Ltd. for 2004 and 2005, with year 2004 not to exceed $33,340.00 Appointment of legal counsel John C. Broihier, Esq. for the Board of Fire and Police Commissioners. 3. 4. Upon roll call: Ayes: Corcoran, Hoefert, Lohrstorfer, Skowron, Wilks, Zadel Nays: None Motion carried. OLD BUSINESS An ordinance was presented for second reading to amend Chapter 18 (Traffic) of the Village Code. The ordinance would remove the one-way eastbound designation along Highland Street between Elm Street and Rand Road, and would prohibit motorists from crossing Rand Road from westbound Highland Avenue to westbound Highland Street. The following residents expressed their opposition to the proposed two-way street, stating the potential for increased traffic and accidents, motorists not obeying speed limits within the neighborhood, and child safety as their main concerns: John Korn, 301 N. William Street Steve Po lit, 601 Wilshire Drive Lou Bertellotti, 522 N. Maple Street Kathy Bjorkquist, 523 N. Emerson Street. Key points of the discussion included suggestions for reopening Gregory and/or Louis Street to allow entry from Rand Road, allowing the two-way designation on Highland Street but prohibiting left turns onto Highland from Rand, and allowing the two-way designation on Highland and prohibiting turns onto it from either direction on Rand Road during certain hours. After much discussion, at the suggestion of Mayor Farley, Trustee Hoefert, seconded by Trustee Corcoran, moved to table this ordinance to a date uncertain. Staff was instructed to conduct a study of traffic patterns of the streets in that area that intersect Rand Road, and submit a comprehensive report including the Highland/Rand area. 3 PZ-38-04 1500 S. BUSSE ROAD ORD. 5463 DEVELOPMENT AGREEMENT, NORWOOD & VOMP MANAGER'S REPORT OTHER BUSINESS NEW BUSINESS The Board held first reading of an ordinance granting final approval to allow the conversion of rental units into condominiums at 1.500 $. .E3.usse Roac!, Lake Park Village Apartments. The Planning and Zoning Commission has recommended approval by a vote of 5-0, and the project had received preliminary approval from the Village Board in June 2004. Petitioner Michael Tobin of Northern Realty Group, Ltd. addressed various questions from the Board. Village Manager Michael Janonis instructed Mr. Tobin to provide all property owners with printed information regarding the Village's parking ordinances. Trustee Wilks, seconded by Trustee Skowron, moved to waive the rule requiring two readings of an ordinance. Upon roll call: Ayes: Corcoran, Hoefert, Lohrstorfer, Skowron, Wilks, Zadel Nays: None Motion carried. Trustee Corcoran, seconded by Trustee Skowron, moved to approve Ordinance No. 5463: AN ORDINANCE GRANTING FINAL APPROVAL OF A PLANNED UNIT DEVELOPMENT AT 1500 SOUTH BUSSE ROAD Upon roll call: Ayes: Corcoran, Hoefert, Lohrstorfer, Skowron, Wilks, Zadel Nays: None Motion carried. A resolution was presented to allow the Village to enter into an agreement with Norwood Builders for the redevelopment of the former Village Hall property at 100 S. Emerson Street. Norwood received approval for a Conditional Use permit in September 2004, to construct a five-story retail/residential facility on the site. With details of the agreement not yet finalized, Mayor Farley asked that the resolution be deferred to the next meeting date. Trustee Zadel, seconded by Trustee Skowron, moved to defer this resolution to the October 19, 2004 Village Board meeting. Upon roll call: Ayes: Corcoran, Hoefert, Lohrstorfer, Skowron, Wilks, Zadel Nays: None Motion carried. VILLAGE MANAGER'S REPORT As a status report, Mr. Janonis noted the October 9 Coffee with Council, and October 16 "Welcome New Residents," both in the Community Center. ANY OTHER BUSINESS None. 4 CLOSED SESSION ADJOURNMENT 1:IW1NIMINUTESIOct 5.2004.doc CLOSED SESSION Mayor Farley stated that there was no need for a Closed Session, as was listed on the meeting agenda.
