Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the l~th day of November , 1986 3467R/61 ORDINANCE NO. 3716 AN ORDINANCE GRANTING A SPECIAL USE FOR PROPERTY COMMONLY KNOWN AS EAST SIDE OF WOLF ROAD BETWEEN EUCLID AND KENSINGTON IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Mt. Prospect State Bank, Trust No. 1365 has filed a petition for a special use and variation with respect to property commonly known as East Side of Wolf Road between Euclid and Kensington, in the Village of Mount Prospect, Illinois; and WHEREAS, the Subject Property is legally described as follows: Ail that part of the West 1/2 of the Southwest 1/4 of Section 25, Township 42 North, Range 11, East of the third principal meridian, lying Westerly of a line drawn 210 feet Westerly of (measured at right angles to and parallel with the Westerly right of way line of Wisconsin Central Railroad) East of the third principal meridian, (except therefrom that part of the Southwest 1/4 of Section 25, Township 42 North, Range 11, East of the third principal meridian, bounded and described as follows: beginning at the intersection of the East line of the West 50 feet of said Southwest 1/4 (being also the East line of Wolf Road) with the South line of the North 50 feet of said Southwest 1/4 (being also the South line of Euclid Avenue): thence East on said South line, to the intersection with the line 210 feet Westerly of, parallel with the Westerly right of way line of the Wisconsin Central Railroad: thence Southerly on said Westerly right of way line 25.24 feet: thence Westerly to a point 20 feet South of and 15 feet East of the place of beginning (as measured on the East line of the West 50 feet aforesaid and on a line at right angles thereto): thence Southwesterly to said East line 65 feet South of the place of beginning: thence North to the place of beginning, in Cook County, Illinois. WHEREAS, Petitioners, seek a special use in the nature of a planned unit development to allow a development of 96 single-family lots and 50,200 square feet of neighborhood shopping center on that portion of the Subject Property to be rezoned to B-3, all in accordance with Section 14.2001.C.3 of Article XX of Chapter 14 of the Village Code of Mount Prospect, Illinois; and WHEREAS, public hearings were held on the proposed special use request (designated as Case No. ZBA-62-SU-86) before the Zoning Board of Appeals of the Village of Mount Prospect on the 27th day of March, 1986, 24th day of April, 1986, 1st day of May, 1986 and on the 9th day of October, 1986, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the llth day of March, 1986; and WHEREAS, the Zoning Board of Appeals has submitted its finding and recommended to the President and Board of Trustees of the Village of Mount Prospect that the proposed special use be denied; and WHEREAS, the President and Board of Trustees have given further consideration to said denial and have determined that the same meets the standards set forth in Section 14.704 of Article VII pertaining o special use of said Chapter 14 of the Village Code and have further determined that the granting of the proposed special use would be in the best interest of the public, provided the same are accomplished pursuant to the conditions hereinafter set forth. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY~ ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a special use to allow thereon a planned unit development of 96 single family lots and 50,200 square feet of neighborhood shopping center on the B-3 portion of the Subject Property; said special use to be in accordance with the conditions hereinafter provided. SECTION THREE: with the exception of the special use granted herein, the Subject Property shall comply with all other applicable Village of Mount Prospect Ordinances and Regulations pertaining thereto. SECTION FOUR: The subject special use shall be granted upon the following conditions: The Subject Property shall be developed in accordance with the site plans and all other documents submitted to the Village. No access to Wolf Road or Kensington Road shall be permitted from any single family lot and a restrictive covenant shall be filed with the final plat of Sub- division to that effect. A six foot (6') board-on-board wood fence shall be constructed in accordance with Village regulations along the Commonwealth Edison right-of-way, Wolf Road and the shopping center at Developers expense. e A Home Owners Association shall be formed which shall be responsible for maintenance of the common area, retention ponds and the Wolf Road and Kensington Road right-of-way adjacent to the single family properties. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage~ approval an publication in pamphlet form in the manner provided by law.
