Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the l~th day of November , 1986 3467R/68 ORDINANCE NO. 3715 AN ORDINANCE AMENDING THE ZONING MAP WITH RESPECT TO THE ZONING OF CERTAIN PROPERTY IN A R-1 SINGLE-FAMILY RESIDENCE DISTRICT IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Mount Prospect State Bank, Trust 1365, the petitioner, herein, has made application to rezone certain portions of property hereinafter described from a R-1 Single-Family Residence District to a B-3 Business Retail and Service District as provided in Article VIII of Chapter 14 of the Village Code of Mount Prospect, Illinois; and WHEREAS, the Subject Property is commonly known as the East Side of Wolf Road from Kensington Road to Euclid Avenue, in the Village of Mount Prospect, Illinois and is legally described in Exhibit A, attached hereto; and WHEREAS, said rezoning request is for the purpose of developing 96 single-family lots and 50,200 square feet of neighborhood shopping center on that portion of the Subject Property to be rezoned B-3; and WHEREAS, public hearings were held on said rezoning application (designated as Case No. ZBA-11-Z-86) before the Zoning Board of Appeals of the Village of Mount Prospect on the 27th day of March, 1986, 24th day of April, 1986, 1st day of May, 1986, and on the 9th day of October, 1986, pursuant to proper publication of due notice thereof in the Mount Prospect Herald on the llth day of March, 1986; and WHEREAS, the Zoning Board of Appeals and recommended to the Board of Trustees requested rezoning be denied; and has forwarded its findings of the Village that the WHEREAS, this Board has considered the findings and recommenda- tions of the Zoning Board of Appeals and does hereby determine it to be in the best interests of the Village to grant the requested rezoning. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are herein as findings of fact by the President and Board of the Village of Mount Prospect. incorporated Trustees of SECTION TWO: The official zoning map pertaining to Chapter 14 entitled "Zoning" of the Village Code of Mount Prospect, Illinois, as amended, is hereby further amended by reclassifying certain portions of the R-1 Single-Family Residence District to a B-3 Business Retail and Service District, which is legally described on Exhibit A attached hereto. ezoning Page 2 of 2 SECTION THREE: The rezonlng to to the B-3 Business District shall be contingent upon development in accordance with the Planned Unit Development requested by the Petitioner and approved by the President and Board of Trustees with the passage of Ordinance No. 37]6 - SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
