Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 6th day of November , 1986 ORDINANCE NO. 3710 AN ORDINANCE GRANTING A SPECIAL USE FOR THE PROPERTY COMMONLY KNOWN AS 113 EAST PROSPECT AVENUE, IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, MARK W. BUSSE has filed a petition for a special use and variation with respect to the property commonly known as 113 East Prospect Avenue, in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Ail of Lot One (1) the North 25 feet of Lot Two (2) in Ethel Busses Subdivision, part of the East half (1/2) of the Northwest quarter (1/4) of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian, according to Plat thereof registered in the Office of the Registrar of Titles of Cook County, Illinois on July 7, 1959 as Document Number 1871841. WHEREAS, Petitioner seeks a special use to allow a special use for five trucks on the Subject Property in accordance with Section 14,2101.C.4 of Article XX of Chapter 14 of the Village Code of Mount Prospect, Illinois; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA 53-SU-86) before the Zoning Board of Appeals in the Village of Mount Prospect on the 25th day of September, 1986, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 10th day of September, 1986; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations in favor of the proposed special use subject to certain conditions to the President and Board of Trustees of the Village of Mount Prospect, and the President and Board of Trustees have given further consideration to the said request and have determined that the same meets the standards set forth in Section 14.704 of Article VII pertaining to special use of said Chapter 14 of the Village Code and have further determined that the granting of the proposed special use would be in the best interest of the public, provided the same are accomplished pursuant to the conditions hereinafter set forth. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a special use to allow thereon rental trucks with the condition that the number of rental trucks shall be limited to five trucks on the Subject Property, and they shall be screened from adjacent residential property; said screening to be approved by the Department of Planning and Zoning. ECTION FOUR: With the exception of the special use granted herein, the Subject Property shall comply with all other applicable Village of Mount Prospect Ordinances and Regulations pertaining thereto. SECTION FIVE: This Ordinance shall be in full fOrce and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
