Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 6th day of November , 1986 3467R/30 ORDINANCE NO. 3707 AN ORDINANCE GRANTING A SPECIAL USE FOR PROPERTY COMMONLY KNOWN AS 1929 AND 2015 WEST GOLF ROAD IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Wolf Point Realty, Inc., of 10 St. John Drive, Hawthorn Woods, Illinois (the "Petitioner"), has filed a petition for a special use-Planned Unit Development in the R-3 Apartment Residence District with respect to property commonly known as 1929 and 2015 West Golf Road, in the Village of Mount Prospect, Illinois; and WHEREAS, Petitioner is the contract purchaser of the Subject Property which is legally described as follows: Lot 10, except the West 2 acres thereof, in Meier Brothers Subdivision of parts of Sections 10 and 15, Township 41 North, Range 11 East of the Third Principal Meridian, Cook County, Illinois. The West 150 feet of Lot 11, being a subdivision of parts of Sections 10 and 15, Township 41 North, Range 11, East of the Third Principal Meridian in Cook County, Illinois. WHEREAS, Petitioner seeks a special use for a Planned Unit Development to allow development of the Subject Property with a 53 unit townhouse residential development in accordance with Section 14.704 of Article VII of Chapter 14 of the Village Code of Mount Prospect, Illinois and in accordance with the Site Plan and exhibits submitted by Petitioner; and WHEREAS, public hearings were held on the proposed special use request (designated as Case No. ZBA-36-SU-86) before the Zoning Board of Appeals of the Village of Mount Prospect on the 26th day of June, 1986 and the 24th day of July, 1986, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 9th day of June, 1986; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation in support of the proposed special use to the President and Board of Trustees of the Village of Mount Prospect, and the President and Board of Trustees have given further consideration to said requests and have determined that the same meets the standards set forth in Section 14.704 of Article VII pertaining to special uses of said Chapter 14 of the Village Code and have further determined that the granting of the proposed special use would be in the best interest of the public, provided the same are accomplished pursuant to the conditions hereinafter set forth. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK C©UNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a special use-Planned Unit Development; said special use to be in accordance with the conditions hereinafter provided. SECTION THREE: The subject special use shall be granted upon the following conditions: ao The development of the Subject Property shall be in substantial conformity with the Site Plan and exhibits submitted by Petitioner and shall be subject to the approval of a Landscape Plan, Roadway and Utility Plan and a Grading Plan by the Planning and Zoning Department. Compliance by the Petitioner with all requirements of the Development Code and payment of all fees and furnishing of all guarantees required for construction. SECTION FOUR: With the exception of the special use granted herein, the Subject Property shall comply with all other applicable Village of Mount Prospect Ordinances and Regulations pertaining thereto. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
