Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 22nd day of October , 1986 3467R/43 ORDINANCE NO. 3703 AN ORDINANCE GRANTING A VARIATIONS FOR THE PROPERTY COMMONLY KNOWN AS 405 MANAWA TRAIL, IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, JOHN REDING has filed an application for variation with respect to the property commonly known as 405 Manawa Trail, in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 12 in Block 29 in Prospect Park Country Club Subdivision being a subdivision of the S.E. 1/4 of Section 11, and the South 15 acres of the East 1/2 of N.E. 1/4 of said Section 11 all in Township 41 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois. WHEREAS, Petitioner seeks the following variation from the provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow a 9 foot wide expansion of the driveway on the Subject Property instead of the normally permitted 18 feet as allowed in Section 14.t16.C of said Article t of Chapter 14 to allow a width of 27 feet; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-58-V-86) before the Zoning Board of Appeals in the Village of Mount Prospect on the 25th day of September, 1986, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 10th day of September, 1986; and WHEREAS, the Zoning Board of Appeals has submitted its finding and recommendation to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees have given further consideration to the variation request and have determined that the same meets the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interests of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, FOLLOWS: AS SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and of Trustees of the Village of Mount Prospect. Board SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.116.C of Article I of Chapter 14 of the Village Code of Mount Prospect, Illinois to allow a driveway width of 27 feet instead of the normally permitted 18 feet. SECTION THREE: The subject variation shall be granted upon the following conditions: (1) that the Driveway be tapered on the South Side. (2) that a hedge of small shrubs be planted in this area as indicated on the attached Site Plan, said planting to be approved by %he Dept. of Planning & Zoning. SECTION FOUR: With the execpetion of the variation granted herein, all other applicable village of ~ount Prospect Ordinances and Regulations pertaining thereto shall remain' in full force and effect as to the Subject Property. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
