Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 22nd day of October , 1986 3467R/52 ORDINANCE NO. 3702 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 302 NORTH EASTWOOD, IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, CHRISTINE and MARION GAZDA have filed an for variation with respect to property commonly known Eastwood (the "Subject Property"); and application as 302 North WHEREAS, the Subject Property is described as follows: Lot Ten (10) in Block Ten (10), in Prospect Manor, being a subdivision of part of the South three quarters (3/4) of the West half (1/2) of the West half (1/2) of Section 34, Township 42 North, Range 11, East of the Third Principal Meridian, as per Plat thereof recorded March 6, 1926, as Document Number 9199191. WHEREAS, Petitioner seeks a variation from the provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois to allow a 4 foot wide expansion of the driveway on the Subject Property from its present width of 18 feet as allowed by Section 14.116.C of Article I of said Chapter 14, to a width of 22 feet and a variation to allow a 3 foot setback to enable the Petitioners to construct a detached garage on the Subject Property instead of the 5 feet as required in Section 14.102 of Article I of said Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-56-V-86) before the Zoning Board of Appeals in the Village of Mount Prospect on the 25th day of September, 1986, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 10th day of September, 1986; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variations, and the President and Board of Trustees of said Village have given further consideration to the variation requests and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interests of the Village to grant the requests for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the village of Mount Prospect hereby grant to the Subject Property the variation request to Section 14.102 of Article I of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow a 3 foot setback instead of the required 5 feet, in accordance to the attached Site Plan. SECTION THREE: Except for the variations granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations pertaining thereto shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
