Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 22nd day of October , 1986 3467R/46 ORDINANCE NO. 3701 AN ORDINANCE GRANTING VARIATIONS FOR THE COMMONLY KNOWN AS 1305 SOUTH BUSSE ROAD, VILLAGE OF MOUNT PROSPECT, ILLINOIS PROPERTY IN THE WHEREAS, WILLIAM AND LORI LUMPP have filed a petition for variations with respect to the property commonly known as 1305 South Busse Road, in the Village of Mount Prospect, Illinois; and WHEREAS, the Subject Property is legally described as follows: Lot 3 in Elk Ridge Villa Unit No. 3, being a subdivision in the Southwest 1/4 of Section 14, and in the Southwest 1/4 of Section 15, all in Township 14 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois. WHEREAS, Petitioners seek a variation from the provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois to allow a 6 foot wide expansion of the driveway on the Subject Property instead of the permitted 18 feet as allowed in Section 14.116.C of Article I to a width of 24 feet, and a variation to reduce the required 30 foot front yard provided in Section 14.1102.A of Article II of said Chapter 14, to allow for a front yard of only 9 feet in order to allow a parking pad to be connected to one side of the existing driveway and to accommodate guest parking; and WHEREAS, a public hearing was held on the variation requests (designated as Case No. ZBA-55-V-86) before the Zoning Board of Appeals in the Village of Mount Prospect on the 25th day of September, 1986, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 10th day of September, 1986; and WHEREAS, the Zoning Board of Appeals has submitted its finding and recommendation in favor of the proposed variations to the President and Board of Trustees of the Village of Mount Prospect, and the President and Board of Trustees have given further consideration to the variation requests and have determined that the same meets the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, this Board further finds that it would be in the best interests of the Village to grant the request for variations. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, FOLLOWS: BOARD OF ILLINOIS, AS SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation request with respect to Section 14.116.C of Article I of Chapter 14 of the Village Code of Mount Prospect, Illinois to allow a 24 foot wide driveway instead of the normally permitted 18 foot driveway and the variation request to reduce the required 30 foot front yard as provided in Section !4.1102.A of Article II of said Chapter 14 to allow for a front yard of only 9 feet. The Subject variation shall be granted with the conditions that no construction equipment be parked on the parking pad. SECTION THREE: With the exception of the variations granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations pertaining thereto shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
