Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 22nd day of October , 1986 3467R/36 ORDINANCE NO. 3700 AN ORDINANCE GRANTING A SPECIAL USE FOR PROPERTY COMMONLY KNOWN AS 1815 PHEASANT TRAIL, IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Sharon L. and William H. Schulze have filed a petition for a special use with respect to property commonly' known as 1815 Pheasant Trail, in the Village of Mount Prospect, Illinois and WHEREAS, the Subject Property is legally described as follows: Lot 514 in "Elk Ridge Villa" Unit No. 6, being a subdivision of Lot 1 and part of Lot 2 in Edward Busse's Division in the Southeast Quarter (1/4) of Section 15, Township 41 North, Range 11, East of the Third Principal Meridian according to plat of said Elk Ridge villa Unit No. 6, registered in the Office of the Registrar of Titles of Cook County, Illinois on April 19, 1965, as Document No. 2204321. WHEREAS, Petitioners, seek a special use to permit a day care home for four to seven children in an R-1 (Residential) District in accordance with Section 1101.C of Article XI of Chapter 14 of the Village Code of Mount Prospect, Illinois; and WHEREAS, a public hearing was held on the proposed special use request (designated as Case No. ZBA-49-SU-86) before the Zoning Board of Appeals of the Village of Mount Prospect on the 28th day of August, 1986, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 12th day of August, 1986; and WHEREAS, the Zoning Board of Appeals has submitted its finding and recommendation in favor of the proposed special use subject to a certain condition to the President and Board of Trustees of the Village of Mount Prospect, and the President and Board of Trustees have given further consideration to said request and have determined that the same meets the standards set forth in Section 14.704 of Article VII pertaining to special use of said Chapter 14 of the Village Code and have further determined that the granting of the proposed special use would be in the best interest of the public, provided the same are accomplished pursuant to the conditions hereinafter set forth. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a special use to allow a day care center in an R-1 (Residential) District; said special use to be in accordance with the condition hereinafter provided. SECTION THREE: The subject special use shall be granted upon the following condition: The clientele of the day care center shall be limited to five children not including the petitioners' own children~ and a maximum of seven (7) including the petitioner's own children. SECTION FOUR: With the exception of the special use granted herein, the Subject Property shall comply with all other applicable Village of Mount Prospect Ordinances and Regulations pertaining thereto. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
