CONSENT AGENDA" MAYOR'S REPORT The Mayor read a resolution of appreciation to Dr, Robert T. Howard, Superintendent of Schools for Community Consolidated School District 59, who will be retiring this year. Elmhurst Road and a Class 'W' liquor license issued to Pete's Sandwich Palace, 712 E. Northwest Highway. COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD Laura Garrison, Mount Prospect Jaycees President, thanked the Village for their efforts in trying to find a place for the group to hold their annual carnival. They will be holding the carnival at the Mount Prospect Plaza and requested a waiver of all fees and out-of-pocket expenses associated with the annual carnival, scheduled for May 26~31, 2004. Trustee Skowron, seconded by Trustee Zadel, moved to waive the fees and out-of- pocket expenses associated with the 2004 Mount Prospect Jaycees Carnival, at Mount Prospect Plaza. Wille, representing her neighbors on North Wille, asked for the Village to help regarding the property at 409 N. Wille. She presented pictures that were forwarded to the Director of Community Development for further investigation. Res. 35-04: A RESOLUTION AUTHORIZING AN AMENDMENT TO THE VILLAGE OF MOUNT PROSPECT FLEXIBLE COMPENSATION PLAN Upon roll call: Ayes: Corcoran, Hoefert, Lohrstorfer, Skowron, Wilks, Zadel Nays: None Motion carried. OLD BUSINESS Community Development Dìrector, Bill Cooney presented Planning and Zoning Case PZ 13-04, 999 N. Elmhurst Road, Randhurst Shopping Center. The proposed ordinance grants an amendment to the Conditional Use permit and a variation to allow for signage and lighting modifications. The Planning and Zoning Commission recommended approval by a vote of 4-2. It was noted that the proposed design of the light fixtures complies with the Village's lighting regulations since it is consìdered a full cutoff fixture that has no measurable light emission above horizontal. The lighting plan also meets the minimum allowed lighting level at all property lines. There was discussion about the phases that the lighting will go up at the center and if there were complaints or concerns about the lights how the center would handle them. Trustee Zadel, seconded by Trustee Lohrstorfer, moved for approval of Ordinance No.5432: AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT AND A VARIATION TO AMEND THE PLANNED UNIT DEVELOPMENT FOR PROPERTY AT 999 NORTH ELMHURST ROAD Upon roll call: Ayes: Corcoran, Hoefert, Lohrstorfer, Skowron, Wilks, lade! Nays: None Motion carried. NEW BUSINESS The Mayor presented the prevailing wage rate ordinance, which is required by the State of Illinois, to adopt the prevailing wages established by the State of Illinois for public works projects provided by contractors. Village Manager, Michael Janonis, presented an ordinance that would bring the Village into compliance with Public Acts 93~165 and 93~617 (State Official and Employees Ethics Acts.) Project Engineer, Matt Lawrie, introduced the following three Safety Commission recommendations to change the signage at the foilowing intersections: I~Oka Avenue and Evergreen Avenue, Prospect Manor Avenue & Memory Lane, and Fairview Avenue & Henry Street. The Safety Commission recommended approval of each by a vote of 7-0. Mr. Lawrie noted that staff would be working on, at the Board's request, comprehensive traffic plans for entire neighborhoods, and that these requests were already being considered prior to that decision. The first ordinance based on the Safety Commission recommendations amends section 18.2004 by removing the yield sign and replacing it with a stop sign at i-Oka Avenue and Evergreen Avenue. Trustee Lohrstorfer, seconded by Trustee Wilks, moved to waive the rule requiring t\vo readings of an ordinance. Upon roll call: Ayes: Corcoran, Lohrstorfer, Skowron, Wilks, lade! Mayor Farley introduced an ordinance that repeals Ordinance Number 5393 which abated parts of the 2003 tax levy and re-established abatements to parts of the taxes levied for corporate and municipal purposes of the Village for the fiscal year beginning January 1, 2003 and ending December 31, 2003. Village Manager, Michael Janonis, noted that there is a June 1st deadline for filing this ordinance with the County, therefore staff is asking for a waiver of the first reading. Trustee Wilks, seconded by Trustee Lohrstorfer, moved to waive the rule requiring two readings of an ordinance. Upon roll call: Ayes: Corcoran, Hoefert, Lohrstorfer, Skowron, Wilks, lade!
