Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 2~ day of August , 1986 467R/16 ORDINANCE NO. AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 507 SOUTH MARINA IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Thomas F. Ryan has filed an application for variation with respect to property commonly known as 507 South Marina in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 7 in Sakowics 1st addition to Mt. Prospect, a subdivision of part of the East half of the Southeast quarter of Section 12, Township 41 North, Range 11, in Cook County, Illinois. WHEREAS, Petitioner seeks the following variation from the provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to vary the minimum rear yard requirements contained Section 14,1102.C of Article XI, of said Chapter 14 to allow a foot rear yard setback instead of the required 25 foot setback; WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-34-V-86) before the Zoning Board of Appeals in the Village of Mount Prospect on the 26th day of June, 1986, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 9th day of June, 1986; and in 23.47 and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect to deny the requested variation and the Petitioner has appealed said denial to the President and Board of Trustees; and WHEREAS, the President and Board of Trustees of said Village have given further consideration to the variation request and have determined that the same does satisfy the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, FOLLOWS: AS SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.1102.C of Article XI, Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow a 23.47 foot rear yard setback instead of the required 25 foot setback. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
