Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 21st day of AuGust , 1986 3467R/4 ORDINANCE NO. 3687 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 1800 WEST CENTRAL ROAD IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, AM International, Inc., Multigraphics Division, has filed an application for variation with respect to the property commonly known as 1800 West Central Road in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: That part of lot "A" in Kirchoff's Subdivision in Sections 10 and 11, in Township 42 North, Range 11 East of the Third Principal Meridian, according to the Plat recorded May 22, 1917 in Book 152 of Plats, at page 15, as document number 6117296, which lies South of a line drawn from a point on the West line of said Lot "A" which is 1315.34 feet South of the Northwest corner of said Lot "A" to a point on the East line of said Lot "A" which is 931.07 feet South of the Northeast corner of said Lot "A", in Cook County, Illinois; Excepting therefrom the following described property conveyed to Commonwealth Edison Company by deed dated July 1, 1959 recorded July 9, 1959 as document number 17592733, described as follows: that part of the North 800 feet (as measured on the East line and West line thereof) of the part of Lot "A" in Kirchoff's subdivision in Section 33, Township 42 North, Range 11 East of the Third Principal Meridian, which lies South of a line drawn from a point on the West line of said Lot "A" which is 1315.34 feet South of the Northwest corner of said lot to a point on the East line of said Lot "A" which is 931.07 feet South of the Northeast corner of said Lot "A" described as follows: commencing at the Southwest corner of said North 800 feet heretofore described, thence East along the South line of said North 800 feet a distance of 493.20 feet to a line 12.50 feet West of the center line of a switch track; of said North 800 feet, as measured from West to North, a distance of 200 feet; thence Northerly and Easterly along the arc of a circle, tangent to the last described line convex to the Northwest and having a radius of 373.55 feet for a distance of 359.38 feet, as measured on said arc, to an intersection with the East line of said Lot "A"; thence North along the East line of said Lot "A" for a distance of 43.61 feet to a line 20 feet South of and parallel with the South line of the North half of the North half of the Southwest quarter of said Section 33; thence West along said parallel line a distance of 652.85 feet to the West line of said lot "A"; thence South along the West line of said Lot "A" a distance of 550.98 feet to the place of beginning; Also excepting therefrom the following described property conveyed to George P. Curran by deed dated June 20, 1961 recorded October 17, 1961 as document number 18304798, described as follows: that part of Lot "A" in Kirchoff's subdivision in Section 33, Township 42 North, Range 11 East of the Third Pricipal Meridian, which lies South of a line drawn from a point on the West line of said Lot "A" which is 1315.34 feet South of the Northwest corner of said lot to a point on the East line of said Lot "A" which is 931.07 feet South of the Northeast corner of said Lot "A" and lying North of a Line 20 feet South of and parallel with the South line of the North half of the North half of the Southwest quarter of said Section 33; also excepting therefrom the West 8 feet thereof dedicated for public street as per document no. 24179728; Also excepting therefrom that part lying South of a line 50 feet North of and parallel with the South line of said Section 33, in Cook County, Illinois. Also The West 406.25 feet, as measured on the South line thereof, of Lot "D" in Kirchoff's subdivision in Section 33, Township 42 North, Range 11 East of the Third Principal Meridian, as per plat thereof recorded May 22, 1917 as document number 6117296, in Cook County, Illinois lying Southerly of the Southerly line of Davis Street, being a line 66.0 feet Southwesterly of and parallel with the Southwesterly line of the Chicago and Northwestern Railway, excepting therefrom that part thereof described as follows: commencing at the intersection of the West line of said Lot "D" with the Southwesterly line of Davis Street, as aforesaid; thence Southeasterly along the Southwesterly line of Davis Street, 250.0 feet; thence South on a line parallel with the West line of said lot, 400.0 feet; thence West on a line drawn at right angles to the West line of said lot, 215.20 feet to the West line of said lot; thence North on the West line of said lot, 527.20 feet to the point of beginning. Als0 excepting therefrom that part thereof lying East of a line parallel with.the West line of said Lot "D" and drawn through a point on the Southwesterly line of Davis Street, as aforesaid, 250.0 feet Southeasterly, as measured along said Southwesterly line of its intersection with the Westerly line of said Lot "D" and lying North of the South line of the North half of the Northwest quarter of the Southwest quarter of said Section 33; and excepting therefrom the East 150.0 feet of the West 406.25 feet of the South 450.0 feet of said Lot "D"; and excepting therefrom that part lying South of a line 50 feet North of and parallel with the South line of said Section 33, in Cook County, Illinois. WHEREAS, Petitioner seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow a height variation to increase the height of a portion of the Petitioner's plant from 31 feet to 55 feet instead of the maximum height of 30 feet otherwise allowed by Section 14.2204.1 of Article XXII of said Chapter 14; and WHEREAS, a (designated as Appeals of the 1986, pursuant Mount Prospect public hearing was held on the variation request Case No. ZBA-42-V-86) before the Zoning Board of Village of Mount Prospect on the 10th day of July, to due and proper notice thereof published in the Herald on the 24th day of June, 1986; and WHEREAS, Petitioner agrees to undertake certain improvements, as follows: 1. Ail 5 incinerators located on the roof shall be screened; The penthouse shall be equipped with an appropriate sprinkler system; The area between the two driveways will include a built up planter area to be filled with shrubs; The driveways will be blacktopped and curbed as per Code. Grass or other appropriate landscaping will over all areas adjacent to these drives. Any exposed gravel surfaces adjacent to the drives will be removed and replaced with landscaping. e The gravel drive area directly north of the retaining wall will be cleaned up. Both the gravel and the iron posts will be removed and replaced with landscaping consisting of a cluster of twenty large (4-5') shrubs; Three large shade trees (4-1/2"+ in diameter) shall be installed as close a possible to the northern most Toluene tank, which trees shall be planted t 35' - 40' intervals at least 25' from the west wall of the building; Se Improvements as required by the Development Code of the Village of Mount Prospect; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation subject to Petitioners installation of the improvements described above. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees the Village of Mount Prospect. of SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.2204.1 of Article XXII of Chapter 14 of the Village Code of Mount Prospect, Illinois to allow a height variation to increase the height of a portion of the Petitioner's plant from 31 feet to 55 feet instead of the maximum of 30 feet permitted by Section 14.2204.1 of Article XXII of Chapter 14 of the Village Code of Mount Prospect. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
