Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 2nd day of July , 1986 ORDINANCE NO. 3676 AN ORDINANCE GRANTING AN AMENDMENT TO A SPECIAL USE FOR THE PROPERTY COMMONLY KNOWN AS MANSIONS OF MOUNT SHIRE, 1821 GOLF RO~D IN THE VILLAGE ©F MOUNT PROSPECT, ILLINOIS WHEREAS, Robert J. DiMucci of Palatine, Illinois (The "Petitioner"), has filed a petition for an amendment to a special use-Planned Unit Development/Consent Decree in the R-A apartment Residence District with respect to property commonly known as Mansions of Mount Shire, 1821 Golf Road, in the Village Of Mount Prospect, Illinois; and WHEREAS, Petitioner is the owner of the subject Property which legally described as follows: Lot 659 in Elk Ridge Villa Unit ~7A being a sub- division of part of Lots 5 and 6 in Division of the Louis F. Busse Farm being a subdivision of part of the Northeast Quarter (NE ¼) of Section 15~ Township 41 North, Range 11, East of the Third Principal Meridian, according to plat of said Elk Ridge villa Unit #7A registered in the Office of Registrar of Title of Cook County, Illinois on October 26, 1971 as Document Number 2589847. WHEREAS, Petit±oner seeks an amendment to a special use for a Planned Unit Development/Consent Decree to allow the enclosure of the existing swimming pool and the addition of a sauna, steam room and sun-deck area in accordance with Section 14.704 of Article VII of Chapter 14 of the Village Code of Mount Prospect, Illinois and in accordance with the plans and other exhibits submitted by Petitioner; and WHEREAS, a public hearing was held on the variation request (designated as Case No~ ZBA-27-SU-86) before the Zoning Board~of~ Appeals in the Village of Mount Prospect on the 15th day of May, 1986, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 29th day of April, 1986; and WHEREAS, The Zoning Board of Appeals has submitted'its findings and recommehdations ~n favor of the proposed special use ~ the President and Board of Trustees of the Village of Mount Prospect, and the President and Board of Trustees have considered said requests and have determined that the same meet the standards set forth in Section 14.704 of Article VII pertaining to special uses of said Chapter 14 of the Village Code and have further determined that the granting of the proposed amendment to special use would be in the best interest of the public, provided the same are accomplished pursuant to the conditions hereinafter set forth. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY/ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property an amendment to special use-Planned Unit Development/Consent Decree; said special use to be in accordance with the conditions hereinafter provided. SECTION THREE: The subject special use shall be granted upon the following conditions: The development of the Subject Property shall be in substantial conformity with the plans. Be Compliance by the Petitioner with all requirements of the Development Code and payment of all fees and furnishing of all guarantees required for construction. Ce Modification of the Consent Decree governing the Subject Property to permit the development of the Subject Property in conformity with the terms of the special use hereby granted. SECTION FOUR: With the exception of the special use granted herein, the Subject Property shall comply with all other applicable Village of Mount Prospect Ordinances and Regulations pertaining thereto. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
