Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 2nd day of July , 1986 3405S/63 ORDINANCE NO. 3675 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 1900 SOUTH ELMHURST ROAD IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Wendy's International has filed an application for variation with respect to property commonly known as 1900 South Elmhurs~ Road (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 3 in Elmhurst Road Plaza, a subdivision of the East 20 acres of the Northeast quarter of the Southeast quarter of Section 23, Township 41 North, Range 11 East of the Third Principal Meridian (except the North 760.96 feet thereof as measured along the West and East lines of said 20 acres; also except the East 50.00 feet thereof used for Elmhurst Road) as recorded December 12, 1977 as Document 24238614 in Cook County, Illinois WHEREAS, Petitioner seeks the following variation from provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois to allow variations from Section 14.2002.C of Article XX of said Chapter 14 to allow a zero lot line setback in the rear instead of the required 20 feet; from Section 14.2005.B.1 of Article XX of said Chapter 14 to eliminate a required truck loading space; and, from Section 14.2005.A.5 of Article XX of said Chapter 14 to reduce the number of required parking spaces from 40 to 38; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-24-V-86) before the Zoning Board of Appeals in the Village of Mount Prospect on the 15th day of May, 1986, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 29th day of April, 1986; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of said Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, FOLLOWS: AS SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.2002.C of Article XX of said Chapter 14 to allow a zero lot line setback in the rear instead of the required 20 feet; from Section 14.2005.B.1 of Article XX of said Chapter 14 to eliminate a required truck loading space; and, from Section 14.2005.A.5 of Article XX of said Chapter 14 to reduce the umber of required parking spaces from 40 to 38, subject to the conditions that the Petit±oner construct an enclosure to ~he existing storage locker with materials compatible with the existing structure and that all deliveries to the permises be made at closing hours. SECTION THREE: Except for the variation granted herein, all other applicable village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
