Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 2nd day of j~y , 1986 ORDINANCE NO~ 3674 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 1798 SOUTH ELMHURST ROAD IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Shell Oil Company has filed an application for variation with respect to property commonly known as 1798 South Elm~urst Road, in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: That part of Lot 4 in Linneman's Division of the South 3/4 of the East half of the North East quarter and of the ~'est half of the -~orth East quarter of Section 23, Township 4] North, Range ll, East of the Third Principal ~Ieridian and the South 477.78 feet of the West half of the South East quarter of Section ]4, Township -North, Range ]1~ East of the Third Principal *~leridian, described as follows: Beginning at the Sot~th East corner of said Lot 4, being also the South East corner of the said North East quarter of Section 23, and 9.22 feet North of the center line of Algonquin Road: thence North along the East lille of said Lot 4 and the East line of said North East quarte~ for a distance of 240.78 feet; thence West along a line which is 200 feet (as measured along said East line) North of and pare]lei with the North line of Algonquin Road, as dedicated by document record in the Recorder's Office of Cook County, ]tlinois~ as No. l]195787: for a distance of 250 feet; thence South para]lei with tl,e East line of Lot 4 for a distance of 239.63 feet to a point on the South line of said Lot 4, which point is 39.63 feet South of the North line.and ]0.37 feet North of the center line of Algonquin Road; thence East along the South line of -Lot 4 and the South line of the North East quarter of said Section _23, for a distance of 250 feet to the piece of beginning, (excepting from the above described premises that part of Elmhurst Road and Algonquin Road included in said dedication recorded as document 11195787), all in Cook County, Illinois. WHEREAS, the Petitioner seeks the following variation from the provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to vary the minimum rear yard requirements and the off-street parking requirements contained in Section 14.2102.C and 14.2101.A.1, respectively, of Article XXI, of said Chapter 14 to allow a 10 foot rear yard setback instead of the required 20 foot setback and to allow 15 stacking spaces for the proposed car wash instead of the required 38 spaces; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-20-V-86) before the Zoning Board of Appeals in the Village of Mount Prospect on the 8th day of May, 1986, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 17th day of April, 1986; and WHEREAS, Petitioner agreed to undertake certain improvements, including reduction in driveway width, grading and drainage improvements in conformity with the Development Code and landscaping pursuant to a Site Plan revised in accordance with recommendations of the Community Development Department; and WHEREAS, The Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of said Village have given further consideration to the variation request and have determined that the same satisfy the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation, subject to Petitioner's installation of the improvements described above. NO?[ THER£~'r~RE, BE IT O~D~.INED BY THE PRESIDENT AK~ ~0ARD 0~ TRUSTEES OF THE VILLAGE OF ~.~OUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of th~village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Sections 14.2102.C and 14.2105.1.A.1, respectively, of A~ticle XXI, Chapter 14 of the Village Code.of Mount Prospect, Illinois, to allow a 10 foot rear yard setback instead of the required 20 foot setback and to allow 15 stacking spaces for the proposed car wash instead of the required 38 spaces subject to Petitioner's compliance with the following conditions: 1. Reduction in driveway width to 24 feet with a flare up t-~30 feet in width at the curb~ Application for resubdivision of the Subject Property into one lot of record. 3. Relocation of 2 parking stalls at Southwest corner of Subject Property. Compliance with Village of Mount Prospect and ~4etropolitan Sanitary District storm sewer, grading and drainage requirements. 5. Compliance with the Development Code as to sidewalk, street lighting and street trees. Submission of a Landscape Plan satisfactory to the Village of Mount Prospect. ReloCation of the trash enclosure at the Northeast corner of the property. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: The Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet formin the manner provided by law.
