Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 18th day of Ju~ , 1986 ORDINANCE NO. 3669 AN ORDINANCE AMENDING CHAPTER 17 OF THE VILLAGE CODE OF MOUNT PROSPECT BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That Section 17.103 of Chapter 17 of the Village Code of Mount Prospect, Illinois, 1981, as amended, entitled "License Fees." is hereby further amended by deleting Section 17.103 in its entirety and substituting in lieu thereof the following: "Sec. 17.103. License Fees. Annual license fees for motor vehicles and trailers of various classifications shall be as follows: First division vehicles, excluding motorcycles, motor driven cycles and motor bicycles: Class Type of Vehicle Annual License Fee W Passenger automobiles $.20.00 The annual fee for a non-commercial vehicle license for a vehicle owned by a resident of age sixty-five (65) or older shall be five dollars ($5.00) for the first vehicle licensed in each year. Additional vehicles owned by such residents shall be licensed at the rate set out above. B. Motorcycles, motor driven cycles and motor bicycles: Class M $16.00 C. Second division vehicles: 1. A self-propelled vehicle operated as a tractor and one semitrailer shall be considered as one vehicle in computing the above license fees, and no additional license fee shall be required for said semitrailer so used. b. The owner of each vehicle who has elected to pay a mileage weight tax to the State of Illinois shall be required to be licensed as in this Chapter provided. D. Trailers. Gross Weight in Lbs. of Annual Class Vehicle plus Its Maximum Load License Fee TAC 3,000 or less $30.00 TBC 3,001 to 5,000 lbs. 40.00 TC 5,001 to 10,000 lbs. 45.00 TD 10,001 to 14,000 lbs. 55.00 TF 14,001 to 20,000 lbs. 60.00 TL 20,001 to 36,000 lbs. 65.00" SECTION TWO: That Section 17.105 of Chapter 17 of the Village Code of Mount Prospect, Illinois, 1981, as amended, entitled "Dealers Licenses" is hereby further amended by deleting Section 17.105 in its entirety and substituting in lieu thereof the following: "Sec. 17.105. Dealers Licenses. Notwithstanding any provision of this Chapter to the contrary, where dealers' number plates issued by the State of Illinois are lawfully used on any vehicle operated in the Village by any person having a residence or doing business in the Village, the annual fee for the Village vehicle license therefor shall be twenty dollars ($20.00). Notwithstand- ing any of the provisions of Section 17.107 to the contrary, the Village license for dealers' vehicles shall consist of a metal plate which shall be attached to the front plate of the State dealers' number plate. Any such Village plate may be transferred to any other vehicle held for sale and used for demonstration under State dealers' number plate by the same dealer who applied for the Village plate." SECTION THREE: That Section 17.107 of Chapter 17 of the Village Code of Mount Prospect, Illinois, 1981, as amended, entitled "License Year; Time of Payment; Late Payment Penalty" is hereby further amended by deleting Section 17.107 in its entirety and substituting in lieu thereof the following: "Sec. 17.107. License Year; Time of Payment; Late Payment Penalty. Beginning in 1986 and continuing each and every year thereafter, license fees established herein shall-be due and payable on or before the first day of May, and licenses issued shall expire on April 30 following the date of issuance. If, after the date license fees become due and payable hereunder, a person acquires a vehicle or becomes a resident of the Village or if a vehicle owned by a person who is a resident of the Village is maintained in storage by virtue of such person's temporary absence from the Village while attending school as a full-time student, or while fulfilling a military obligation on permanent assignment to a military base or station, or for such other reason whereby the vehicle in question is in storage within the Village and is not used on the public streets or highways, then the license fees provided for in Section 17.103 shall be due and payable within thirty (30) days after such vehicle is acquired or new residence is established, or such vehicle is removed from storage and placed in use and operation upon the streets and highways of this Village. Where the said fee becomes due and payable six (6) months or more after the start of the license year, then the license shall be issued for the remainder of the year upon payment of one-half (1/2) of the fee provided for in Section 17.103. A late license fee provided for in Section 17.103 by all persons who purchase the license after the due date set forth in this Section. The late payment fee schedule is as follows: 50% of license fee if purchased after April 30 75% of license fee if purchased after July 1 100% of license fee if purchased after September SECTION FOUR: That SubSe~i~ ~ 6f section 17.108 of Chapter 1 of the Village Code of Mount Prospect, Illinois, 1981, as amended, entitled "Plates and Windshield Sticker" is hereby further amended by deleting Subsection B in its entirety and substituting in lieu thereof the following: "B. There shall be an additional charge of two dollars ($2.00) to the fee set forth in Section 17.103 to replace during the year any windshield sticker or plates which have been mutilated, destroyed or lost or for a transfer caused by the sale of the vehicle to which the original sticker or plates were affixed." SECTION FIVE That Subsection E of Section 17.110 of Chapter 17 of the Village Code of Mount Prospect, Illinois, 1981, as amended, entitled "Violation Citations" is hereby further amended by deleting Subsection E in its entirety and substituting in lieu therof the following: "E. The violation claim described in said citation to be issued pursuant to the terms of this Chapter, may be settled, compro- mised and paid in the respective amounts set forth in the following schedule: In the event that said payment is made prior to the mailing by the Municipality or by the peace officer of a final notice, twenty-five dollars ($25.00) shall be accepted as payment. In the event that payment has not been paid prior to the mailing of such final notice, and in fact, final notice has been mailed,~thirty-five dollars ($35.00) shall be accepted as settlement. In the event that payment is not made within the time prescribed in the final notice, and a notice to appear has been served or a complaint filed in the Circuit Court of Cook County, payment of any fine and costs shall be in such amount not less than fifty dollars ($50.00), nor more than three hundred dollars ($300.00) as may be determined and established by the Circuit Court of Cook County for any such offense." SECTION SIX: That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION SEVEN: That this ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
