Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 18thday of June , 1986 ORDINANCE NO. 3668 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 1910 EAST EUCLID AVENUE IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Mr. Kenneth Whitl w has filed an application for variation with respect to property commonly known as 1910 East Euclid Avenue in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot Twenty-nine (29) in Alten's Euclid Avenue Subdivision of that part of the South 133.5 feet of the Northeast Quarter (~) of Section 25, Town 42 North, Range 11, East of the Third Principal.Meridian, lying West of a line, drawn at right angles to the South line of said Northeast Quarter (¼) at a point 347.56 feet West of the center line of River Road, also that part of the North Half (%) of the Northeast Quarter (¼) of the Southwest Quarter(b) of said Section 25, lying North of the North line of the South 18½ rods therof, also that part of the Southeast Quarter(~) of said Section 25, lying North of the North line of the South 18% rods of the North 40 rods of the said Southeast Quarter (~) except therfrom that part therof heretofore dedicated for roads. WHEREAS, Petitioner seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois to allow a second garage on a single lot with access to the garage by a second driveway in variance to Section 14.1101.B.3 providing for a maximum of one (1) garage per lot, and Section 14.116.A permitting only one (1) driveway per lot; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-21-V-86) before the Zoning Board of Appeals in the Village of Mount Prospect on the 8th day of May, 1986, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 17th day of April, 1986; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of said Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation, subject to the conditions hereinafter set forth. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation equested with respect to Section 14.1101.B.3 and Section 14.116.A of Chapter 14 of the Village Code of Mount Prospect, Illinois to allow a second garage on a single lot with access to the garage by a second driveway upon the condition that no other accessory building shall be located upon the Subject Property. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
