Published in pamphlet form by the authority of the corporate authorities of the Village of Mount Prospect, Illinois, the !Sth day of June , 1986 ORDINANCE NO. 3667 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 506 SOUTH EMERSON STREET IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Mr. Franklin Auwarter has filed an application for variation with respect to property commonly known as 506 South Emerson Street in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lots 3 and 4 in block 4 in Prospect Highlands, being a Subdivision of the Westerly 379.4 feet of the East half of the North 60 rods of the SouthWest quarter of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian (except the North 33 feet thereof dedicated for public road) in Cook County, Illionis WHEREAS, Petitioner seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois to allow a second garage on a single lot with access to the garage by a second driveway to the rear of the Subject Property in variance to Section 14.1101.B.3 providing for a maximum of one (1) garage per lot, and Section 14.116.A permitting only one (1) driveway per lot; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-18-V-86) before the Zoning Board of Appeals in the Village of Mount Prbspect on the 8th day of May, 1986, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 17th day of April, 1986; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of said Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation, subject to the conditions hereinafter set forth. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION ~0: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.t101.B.3 and Section 14.116.A of Chapter 14 of the Village Code of Mount Prospect, Illinois to allow a second garage on a single lot with access to the garage by a second driveway to the rear of the Subject Property upon the conditions that no other accessory building shall be located upon the Subject Property. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
