ORDINANCE NO. 3777 AN ORDINANCE GRANTING A SPECIAL USE FOR THE PROPERTY COMMONLY KNOWN AS NORTHWEST CORNER OF WOLF ROAD AND FEEHANVILLE DRIVE IN KENSINGTON CENTER IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Opus Corporation has filed a petition for a special use with respect to the property commonly known as the Northwest corner of Wolf Road and Feehanville Drive in Kensington Center, in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: The East 540 feet of Lot 801 in Kensington Center - Phase Six, a subdivision in part of the North half of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian, per plat thereof filed for record in the office of the Registrar of Titles of Cook County, Illinois, March 21, 1986 as LR~3502998 and also recorded as Document #86-159151, all in Cook County, Illinois; and WHEREAS, Petitioner seeks a special use to allow a Planned Unit Development and a waiver of ten percent (10%) of the bonus requirement for off-street parking on the Subject Property in accordance with Section 14.2500 of Article XXV of Chapter 14 of the Village Code of Mount Prospect, Illinois; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA 8-SU-87) before the Zoning Board of Appeals in the Village of Mount Prospect on the 12th day of March, 1987, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 24th day of February, 1987; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations in favor of the proposed special use subject to certain conditions to the President and Board of Trustees of the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees have given further consideration to the said request and have determined that the same meets the standards set forth in Section 14.704 of Article VII pertaining to special use of said Chapter 14 of the Village Code and have further determined that the granting of the proposed special use would be in the best interest of the public, provided the same are accomplished pursuant to the conditions hereinafter set forth. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. Page 2 ZBA 8-SU-87 SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a special use to allow thereon a Planned Unit Development for the subject property to construct a four (4) story office building with a maximum height of fifty-five feet (55') and a maximum gross floor area of one hundred sixty-five thousand (165,000) square feet subject to the following conditions: Se A maximum fifty-five feet (55') high to top of parapet; The height of the penthouse shall not exceed approximately nine feet (9'); Berming along Wolf and Kensington Roads to screen parking shall be required; d. Petitioner shall install conduit under Wolf Road and work out the costs for lighting with staff; The materials and color scheme should be similar to that used for the existing 4 story building; This building will be connected to an existing twelve inch (12") sanitary sewer on the South side of Feehanville Drive; Ail storm water and overland drainage shall be diverted to the existing detention basin at the Southeast corner of the lot. No direct drainage to the creek shall be allowed. No filling of the floodplain shall be allowed; There is an existing eight inch (8") stub with a valve and vault from the sixteen inch (16") water- main on Feehanville Drive. Booster pumps may be required to supply water pressure to the upper floors which would be the responsibility of Opus; Street lighting, parkway trees and sidewalks will be required along public right-of-ways to conform to the Annexation Agreement; Provide buffering Road and redesign building; to screen loading from Kensington the area to the North of the Re Develop additional landscaping acceptable to staff along the Northern boundary; To create "bypass" lanes at Feehanville on Wolf in accordance with Traffic Engineers report; and, The access on Feehanville Drive be limited to right-in/right-out only. SECTION THREE: With the exception of the special use granted herein, the Subject Property shall comply with all other applicable Village of Mount Prospect Ordinances and Regulations pertaining thereto. age 3 ZBA 8-SU-87 SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
