ORDINANCE NO. 3772 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 610 CEDAR LANE IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Edmund Jamison has filed an application for variation with respect to property commonly known as 610 Cedar Lane in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 41 in Brickman Manor First Addition unit number 1, being a Subdivision of part of the East 1/2 of the South East 1/4 of Section 27 and part of the West 1/2 of the West 1/2 of the South West 1/4 of Section 26, Township 41 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois; and WHEREAS, Petitioner seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a deck to be built on the Subject Property to within sixteen feet (16') four inches (4") of the rear property line, within a zoning district otherwise requiring a twenty-five foot (25') rear yard pursuant to Section 14.1102 of Article XI of Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA 9-V-87) before the Zoning Board of Appeals of the Village of Mount Prospect on the 26th day of March, 1987, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 6th day of March, 1987; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.606 of Article VI of Chapter 14 of the village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees Of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.1102 of Article XI of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a deck to within sixteen feet (16') four inches (4') of the rear property line in accordance with the site plan attached hereto. ECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
