Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 9th day of April , 1987. ORDINANCE NO. 3763 AN ORDINANCE MODIFYING SECTIONS OF CHAPTER 16 ENTITLED "DEVELOPMENT CODE" OF THE VILLAGE CODE OF MOUNT PROSPECT WHEREAS, Gregory A. Miller and Christopher M. Cappuccilli, have requested a modification of the Development Code pertaining to requirements of pedestrians sidewalks, and a cul-de-sac for Bonita Avenue, East of Busse Road; and WHEREAS, the Plan Commission of the Village of Mount Prospect, Cook County, Illinois, has reviewed the proposed modifications to Chapter 16, Development Code, of the Village Code of Mount Prospect for property commonly known as That part of Lot "K" in Kirchoff Subdivision of the Northwest Quarter of the Northwest Quarter and the North 10 chains of the Southwest Quarter of the Northwest Quarter of Section 11, Township 41 North, Range 11, East of the Third Principal Meridian, described as follows: commencing at a point in the West line said lot "K" 150 feet South of the Northwest corner therof; thence South of the West line of said lot "K", 226.72 feet more or less to a point, 283.66 feet North of the Southwest corner of said lot "K", 759.49 feet to the center of Weller creek; thence Northerly along to the center of Weller Creek; 226.73 feet, more or less to a line 150 feet South, (as measured on the West line of lot "K") of said parallel line with the North line of said lot "K"; thence West on said parallel line 751.19 feet to the place of beginning, in Cook County, Illinois, and; WHEREAS, the Plan Commission has forwarded its recommendations relative to modifications to Chapter 16, Development Code, to the President and Board of Trustees, which recommendations have been considered at a regular meeting of the President and Board of Trustees; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined the best interests of the Village of Mount Prospect will be attained by the adoption of the recommendations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That modifications from Chapter 16 entitled "Development Code" of the Village Code of Mount Prospect are hereby granted, for the property being the subject of this Ordinance, as to Section 16.403.A.5.a requiring a maximum cul-de-sac length of five hundred feet (500') and Section 16.403.A.9.a which requires sidewalks along both sides of all streets is hereby modified to permit a cul-de-sac with a length of five hundred and three feet (503') and sidewalks along the south side of the proposed street and around the bulb of the cul-de-sac but not along the north side of the street. ECTION TWO: That this OrdinaDce shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
