ORDINANCE NO. 3759 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS THE CORNER OF CENTRAL AND RAND ROADS IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Mount Prospect Plaza Limited Partnership has filed an application for variation with respect to property commonly known as the corner of Central and Rand Roads in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Attached hereto as Exhibit A and WHEREAS, Petitioner seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of parking and access drives located within ten feet (10') of the North property line (rear yard) and to the East property line (side yard) on the Subject Property, within a zoning district otherwise requiring a twenty foot (20') rear yard and a ten foot (10') side yard pursuant to Section 14.2002.B and Section 14.2202.C of Article XX of Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA 71-V-86) before the Zoning Board of Appeals of the Village of Mount Prospect on the 22nd day of December, 1986, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 8th day of January, 1987; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.606 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.2002.B and Section 14.2002.C of Article XX of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the planting of landscape material in accordance with the preliminary landscape plan attached as Exhibit B with such plant material to be approved by the Department of Planning and Zoning. ECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force from and after its passage, approval and publication form in the manner provided by law.
