Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 4th day of March , 1987. 4293S ORDINANCE NO. 3751 AN ORDINANCE AMENDING CHAPTER 13 ENTITLED, "ALCOHOLIC LIQUOR DEALERS" OF THE VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS TO ADD THE CLASS "Z" LICENSE CLASSIFICATION BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: Chapter the Village Code of Mount hereby further amended as 13 entitled "Alcoholic Liquor Dealers" of Prospect, Illinois (1981) as amended, is follows: A. By amending Section 13.106 entitled, "Licenses and Permits" of said Chapter 13 to change subsection A.1 thereof by adding a Class "Z" license classification, to be placed in alphabetical order within said subsection to read as follows: "CLASS "Z" license, for issuance to restaurants maintaining a separate lounge area as an incidental and accessory use, which shall authorize the licensee to sell and offer for sale at retail, in the restaurant portion of the premises specified in such license, alcoholic liquor for consumption on sa~d premises only with meals, and in the lounge portion of the premises specified in such license, alcoholic liquor for consumption on said premises, with or without the service of food. The premises licensed herein shall be primarily devoted to the preparation, cooking and serving of meals and the lounge area shall contain less than 40% of the floor area of the premises and shall not be divided into three or more locations within said premises. Full food service, including dinner and/or luncheon menus, shall be offered at all times while alcoholic liquor is served." B. By amending Section 13.106 entitled, "Licenses and Permits" of said Chapter 13 to change subsection A.3 thereof to read: "3. Each such licensee shall pay an annual fee for such license in the amount set forth below: License Classification Annual License Fee Class A $2,500.00 Class B $2,000.00 Class C $2,000.00 Class D $ 750.00 Class E $2,000.00 Class F $2,000.00 Class G $ 750.Q0 Class H $2,000.00 Class M $2,500.00 Class P $1,750.00 Class R $2,000.00 Class S $2,500.00 Class V $1,500.00 Class W $1,500.00 Class Z $2,500.00 C. By amending Section 13.107 entitled, "Licenses and Permits" of said Chapter 13 to change subsection A.2 hereof to read: "Section-13~107~ Number of Licenses: Four (4) Class Two (2) Class Nine (9) Class Two (2) Class Two (2) Class One (1) Class One (1) Class One (1) Class One (1) Class One (1) Class Sixteen (16) Class Fifteen (15) Class One (1) Class Seven (7) Class One (1) Class A Licenses B Licenses C Licenses D Licenses E Licenses F License G Licensei~~ H License~I M License~~ R Licenses S Licenses~ V Licensei~/i W Licenses Z License " D. By amending Section 13.115 entitled "Closing Hours; Sunday Closing" of said Chapter 13 to read: "Closing Hours;Sunday Closing. A. It shall be unlawful for all licensees holding liquor license classifications other than C, G and Z created under the terms of this Chapter to sell or offer for sale any alcoholic liquor at retail in the Village or to permit any person to consume any alcoholic liquor in or on any premises for which a license providing for consumption on the premises has been issued pursuant to this Chapter 13, between the hours of one o'clock (1:00) A.M. to eleven o'clock (11:00) A.M. on Monday through Friday, inclusive; between the hours of two o'clock (2:00) A.M. and 11 o'clock (11:00) A.M. on Saturday; between the hours of two o'clock (2:00) A.M. and twelve (12:00) noon on Suhday; and on January 1 of each year said closing hours shall be from four o'clock (4:00) A.M. to twelve (12:00) noon. Be It shall be unlawful for licensees holding a Class C liquor license created under the terms of this Chapter to sell or offer for sale any alcoholic liquor at retail in the Village between %he hours of one o'clock (1:00) A.M. and eight o'clock (8:00) A.M. on Monday through Friday, inclusive; between the hours of two o'clock (2:00) A.M. and eight o'clock (8:00) A.M. Saturday; between the hours of two o'clock (2:00) A.M. and twelve o'clock (12:00) noon on Sunday; and January 1 of each year said closing hours shall be from four o'clock (4:00) A.M. and twelve o'clock noon. C® It shall be unlawful for licensees holding a Class G liquor license created under the terms of this Chapter to sell or offer for sale any alcoholic liquor at retail in the Village or to permit any person to consume any alcoholic liquor in or on any premises for which a license providing for the consumption on the premises has been issued pursuant to this Chapter 13 other than between eleven o'clock (11:00) A.M. and ten (10:00) P.M. on Monday through Friday, inclusive; -2- etween the hours of eleven o'clock (11:00) A.M. on Saturday and two o'clock (2:00) A.M. on the following Sunday; and between the hours of twelve o'clock (12:00) noon and ten o'clock (10:00) P.M. on Sunday. De It shall be unlawful for licensees holding a Class Z liquor license created under the terms of this Chapter to sell or offer for sale any alcoholic liquor at retail in the Village or to permit any person to consume any alcoholic liquor in or on any premises for which a license providing for consumption on the premises has been issued pursuant to this Chapter 13 other than between four o'clock (4:00) A.M. and eleven o'clock (11:00) A.M. on Monday through SUnday, inclusive, until April 30, 1988; and thereafter between one o'clock (1:00) A.M. and eleven o'clock (11:00) A.M. on Monday through Friday; between two o'clock (2:00) A.M. and eleven o'clock (11:00) A.M. on Saturday and Sunday; and January 1 of each year said closing hours shall be from four o'clock (4:00) A.M. and (12:00) noon. It shall be unlawful for any premises for which a retail liquor dealer's license has been is'sued pursuant to this Chapter to keep open for business or to admit the public to any premises in or on which alcoholic liquor is sold at retail during the hours within which the sale of such liquor is prohibited; provided, that retail establishments, restaurants and clubs may be kept open during said hours, but no alcoholic liquor may be sold or consumed by the public during such hours, but nothing contained in this Section shall be deemed to ~uthorize any such retail establishment, restaurant or club to keep eden for business or to admit the public to such premises at or during any hour when such premises are required to be closed by virtue of the regulations or restrictions imposed by any other provisions of this Village Code." SECTION TWO: The Class "Z" license classification listed herein is created pursuant to the requirements of Chapter 24, paragraph 7-1-44 of the Illinois Revised Statutes, as amended. All provisions of this Ordinance relating to the Class "Z" license classification shall expire at twelve o'clock (12:00) A.M. on May l, 1988. SECTION THREE: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
