Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 19th day of February, 1987. ORDINANCE N0.3748 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 4 SOUTH OWEN STREET IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Fredrick Thulin has filed an application for variation with respect to property commonly known as 4 South Owen St in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 2 in Resubdivision of Block 7 in Busse's Eastern Addition to Mount Prospect being a Subdivision of that part of the Northeast Quarter (1/4) of Section 12, Township 41 North, Range 11 East of the Third Principal Meridian, North of the right-of-way of the C&NW Ry and also Lot 1, in Oehlerking's Division of land in the Southeast Quarter (1/4) of said Northeast Quarter (1/4), all in Cook County, Illinois, and WHEREAS, Petitioner seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the expansion of a single family detached dwelling to be built on the Subject Property with a Floor Area Ratio of .397, within a zoning district otherwise requiring a Floor Area Ratio of .35 pursuant to Section 14.11000 of Article XI of Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA 2-V-87) before the Zoning Board of Appeals of the Village of Mount Prospect on the 22nd day of January, 1987, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 6th day of January, 1987; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.606 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount P~ospect hereby grant to the Subject Property the variation requested with respect to Section 14.11000 of Article XI of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the expansion of a single family detached dwelling with a Floor Area Ratio of .397 subject to the removal of all debris and litter from the property and the prohibition of any business operating out of the home. age 2 ZBA 2-V-87 SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided bY law.
