ORDINANCE NO. 3745 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 304 N DALE IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Robert Benwitz has filed an application for variation with respect to property commonly known as 304 N Dale in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 29 in H. Roy Berry Company's North-West Heights, being a Subdivision of all that land lying North of the Chicago and Northwestern Railway in the Northwest 1/4 of the Southeast 1/4 of Section 33, Township 42 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois and WHEREAS, Petitioner seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a detached garage/tool shed seven feet (7') from the principal structure in the side yard on the Subject Property within a zoning district otherwise requiring construction in the rear yard and ten feet (10') from the principal structure pursuant to Section 14.102.B.1 of Article I of Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA 70-V-86) before the Zoning Board Appeals of the Village of Mount Prospect on the 8th day of January, 1987, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 22nd day of December, 1986; and of WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.606 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President Board of Trustees of the Village of Mount Prospect. and SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.102.B.1 of Article I of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a detached garage/tool shed seven feet (7') from the principal structure in the side yard on the Subject Property. age 2 ZBA 70-V-86 SECTION THREE: Except for other applicable Village of Regulations shall remain in Subject Property. the variation granted herein, all Mount Prospect Ordinances and full force and effect as to the SECTION FOUR: This Ordinance shall from and after its passage, approval form in the manner provided by law. be in full force and effect and publication in pamphlet PASSED and APPROVED AYES: Arthur, NAYS: None ABSENT: None Farley, this .... 3rd . day of February , 1987.
