Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 4th day of February, 1987. ORDINANCE NO. 3743 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 714 NOAH TERRACE IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Alvaro Vargas has filed an application for variation with respect to property commonly known as 714 Noah Terrace in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 17 in St. Cecilia Subdivision, being a resubdivision of Lot 2 and part of lots 3 and 6 in Meier Brothers Subdivision, being a subdivision of parts of Section 10 and 15, Township 41 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois and WHEREAS, Petitioners seek a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a patio to be built on the Subject Property to within seventeen and one-half feet (17.5') of the rear property line, within a zoning district otherwise requiring a twenty-five foot (25') rear yard pursuant to Section 14.1102.C of Article XI, Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA 69-V-86) before the Zoning Board of Appeals of the Village of Mount Prospect on the 18th day of December, 1986, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 1st day of December, 1986; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.606 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY TRUSTEES OF THE VILLAGE OF MOUNT AS FOLLOWS: THE PRESIDENT AND BOARD OF PROSPECT, COOK COUNTY, ILLINOIS, SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.1102.C of Article XI of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the continuation of an existing patio to within seventeen and one-half feet (17.5') of the rear property line, in accordance with the Site Plan attached hereto as Exhibit A. age 2 ZBA 69-V-86 SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall from and after its passage, approval form in the manner provided by law. be in full force and effect and publication in pamphlet PASSED and APPROVED this 3rd day of February , 1987.
