Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the '31st day of December , 1986. ORDINANCE NO. 3?33 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 402 PROSPECT MANOR IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Michael Radokovich filed an application for variation with respect to property commonly known as 402 Prospect Manor in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 10 in Block six (6) in Prospect Manor, being a subdivision of part of South Three Quarters (3/4) of the West Half (1/2) of Section 34, Township 42 North, Range 11 East of the Third Principal Meridian in Cook County, Illinois; and WHEREAS, Petitioner seek a variation from the following provision of Section 14.102.B.2 of Article I of Chapter 14 to allow a side yard (north) of 0.72 feet instead of the five (5) feet required, for a detached garage to be constructed on the Subject Property; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-65-V-86) before the Zoning Board Appeals of the Village of Mount Prospect on the 20th day of November, 1986, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 4th day of November, 1986; and of WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect with a vote of 5-0 in favor of the application to allow the requested variation; and WHEREAS, the President and Board of Trustees of the Village have given further consideration to the variation requests and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variations. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President Board of Trustees of the Village of Mount Prospect. and SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.102.B.2 to allow a side yard (north side) of 0.72 feet instead of the five feet (5' required, to allow a detached garage to be constructed on the Subject Property; and BA 65-V-86 Page 2 of 2 SECTION THREE: The subject variation shall be granted upon the following conditions: (1) That the detached garage shall be set back from the North property line a minimum of 0.72 feet which shall be measured from the nearest edge of the garage; including overhang. (2) That the improvements shall be completed in general conformance with the Exhibits submitted to the Zoning Board of Appeals and with the site plan attached hereto as Exhibit A. SECTION FOUR: Except for the variations granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FIVE: This Ordinance shall be in full force from and after its passage, approval and publication form in the manner provided by law. and effect in pamphlet PASSED and APPROVED this 30th day of December , 1986.
