ORDINANCE NO. 3720 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 701 CANDOTA AVENUE IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Dennis Garde has filed an application for variation with respect to property commonly known as 701Candota Avenue in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 11 in Block 27 in Prospect Park Country Club being a subdivision of the South East quarter of Section 11 and the South 15 acres of the East half of the North East quarter of said Section 11, Township 41 North, Range 11 East of the Third Principal Meridian in Cook County, Illinois WHEREAS, Petitioner seek a variation from the following provisions of Section 14.1102.B, Section 14.102.B, Section 14.116.A and Section 14.116.D of Article II of Chapter 14 to allow a side yard (south) of six (6) feet instead of the ten (10) feet required, to allow a second garage on one lot, to allow a second driveway, and to allow grass block paver for the new driveway instead of concrete or bituminous to be constructed on the Subject Property; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-59-V-86) before the Zoning Board Appeals of the Village of Mount Prospect on the 23rd day of October, 1986, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 6th day of October, 1986; and of WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variations; and WHEREAS, the President and Board of Trustees of the Village have given further consideration to the variation requests and have determined that the same satisfies the standards set forth in Section 14.1102.B, Section 14.102.B, Section 14.116.A, and Section 14.116.D of Article II of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variations. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variations requested with respect to Section 14.1102.B, Section 14.102.B, Section 14.116.A, and Section 14.116.D of Article II of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow to allow a side yard (south side) of six feet (6') instead of the ten feet (10') required, to allow a second garage on one lot, to allow a second driveway, and to allow grass block pavers for the new driveway instead of concrete on bituminous to be constructed on the Subject Property; and BA 59-V-86 Page 2 of 2 SECTION THREE: The subject variation shall be granted upon the following conditions: (1) The maximum width of the driveway for the attached garage shall be twelve (12) feet. (2) There shall be no openings (windows or doors) on the south side of the studio/garage addition. (3) The addition shall be constructed with a maximum of eighteen inch (18") overhang on the studio/garage addition. (4) No additional accessory structures will be constructed on the property. (5) That the improvements shall be completed in general conformance with the Exhibits submitted to the Zoning Board of Appeals and with the site plan attached hereto as Exhibit A. SECTION FOUR: Except for the variations granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
