Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 22nd day of July , 1987. ORDINANCE NO. 3805 AN ORDINANCE MODIFYING SECTIONS OF CHAPTER 16 ENTITLED "DEVELOPMENT CODE" OF THE VILLAGE CODE OF MOUNT PROSPECT WHEREAS, Harvest Homes Development has requested a modification of the Development Code pertaining to requirements for development of a single-family subdivision; and WHEREAS, the Plan Commission of the Village of Mount Prospect, Cook County, Illinois, has reviewed the proposed modifications to Chapter 16, Development Code, of the Village Code of Mount Prospect for property commonly known as See attached Exhibit "A"; and WHEREAS, the Plan Commission has forwarded its recommendations relative to modifications to Chapter 16, Development Code, to the President and Board of Trustees, which recommendations have been considered at a regular meeting of the President and Board of Trustees; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that additional lots should be permitted with a depth of less than the minimum to improve traffic safety in the subdivision and have determined the best interests of the Village of Mount Prospect will be attained by the adoption of the recommendations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That modifications from Chapter 16 entitled "Development Code" of the Village Code of Mount Prospect are hereby granted, for the property being the subject of this Ordinance, as follows: 1. Section 16.408.A.1, to allow elimination of the requirement from parkway trees along Gregory. Section 16.403.A.9.a, to allow a four foot (4') sidewalk along one side of Gregory in lieu of the normally required five foot (5') sidewalk along both sides. Section 16.403.A.2, to allow Gregory to be improved with a forty foot (40') Right-of-Way in lieu of the normally required sixty-six foot (66') Right- of-Way. Section 16.405.F.2.e, to allow detention basins with a side slope of 4:1 in lieu of the normally required 6:1 slope. Section 16.405.F.1, to allow detention basins to be located twenty feet (20') from a building instead of the normally required separation of seventy five feet (75'). Section 16.403.C.2.e, to allow a minimum lot depth of less than the required one hundred twenty feet (120') for lots 1,9,10,11,12,13,14,15,16,24,25, and 46 in accordance with the preliminary plat submitted and attached hereto as Exhibit "B"; subject to the condition of a restrictive covenant being placed on these lots to prevent encroachments in the required yards. ECTION TWO: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
