Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 22nd day of July , 1987. ORDINANCE NO. 3804 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS HARVEST HOMES DEVELOPMENT IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Harvest Homes Development has filed an application for variation with respect to property commonly known as 22 acres east and adjoining Courtesy Home Center on Rand Road in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Attached Exhibit "A" and WHEREAS, Petitioner seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a single family detached dwelling to be built on a portion of the Subject Property known as (lot 10,13,14 and 15) within the proposed Harvest Home Subdivison with a lot width of less than sixty-five feet (65'), within a zoning district otherwise requiring sixty five foot (65') in lot width pursuant to Section 14.1101.A.1 and a rear yard of twenty feet (20') for lot 16 within a zoning district otherwise requiring a rear yard of twenty-five feet (25') pursuant to Section 14.1102.C of Article XI of Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA 41-V-87) before the Zoning Board of Appeals of the Village of Mount Prospect on the 11th day of June, 1987, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 25th day of May, 1987; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that additional variations, as stated herein, are in the public interest to improve traffic safety, and have determined that the same satisfies the standards set forth in Section 14.606 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.1101.A.1 of Article XI of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a single family home on the portion of the Subject Property known as Lot 10,13,14,and 15 within the proposed Harvest Home Subdivision with a lot width of less than sixty-five feet (65') within a District otherwise requiring sixty five feet (65') in lot width, and and a rear yard of twenty feet (20') for lot 16 within a zoning district otherwise requiring a rear yard of twenty-five feet (25'). SECTION THREE: Except for the variation granted herein, all age 2 ZBA 41-V-87 other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
