Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 22nd day of July , 1987. ORDINANCE NO. 3799 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 1758 TANO LANE IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, David Tesnow, has filed an application for variation with respect to property commonly known as 1758 Tano Lane in the Village of Mount PrOspect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: lot 113 in Brickman Manor Second Addition, Unit Number Four, being a Subdivision of part of the Northwest 1/4 of Section 25, Township 42 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois; and WHEREAS, Petitioner seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a accessory structure to be built on the Subject Property to be located one foot (1') from the principal structure and a setback of one and one-half foot (I-1/2') from the lot line, within a zoning district otherwise requiring at least ten feet (10') from a principal structure and a setback of five feet (5') from an interior lot line pursuant to Section 14.102 of Article I of Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA 25-V-87) before the Zoning Board Appeals of the Village of Mount Prospect on the 28th day of May, 1987, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 13th day of May, 1987; and of WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect to deny the requested ~ariation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.606 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.102 of Article I of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of an accessory structure to be located one foot (1') from the principal structure and a interior lot line setback of one and one-half foot (1 1/2') from the lot line provided that the Petitioner shall comply with the requirements of the Code Enforcement Department regarding fire safety for construction of the shed and storage of materials within said shed. age 2 ZBA 25-V-87 SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
