ORDINANCE NO. 379~ AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS BRENTWOOD SUBDIVISION IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Hoffman Group Inc., has filed an application for variation with respect to property commonly known as Brentwood Subdivision in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Brentwood Subdivision being a Subdivision of part of the West 1/2 of the Southwest 1/4 of Section 25, Township 42 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois; and WHEREAS, Petitioner seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of single-family homes to be built on the Subject Property with a maximum Floor Area Ratio of .365 and allowing patios or decks to encroach within ten feet (10') of the rear property line, within a zoning district otherwise requiring a Floor Area Ratio of .35 and a rear yard of twenty-five feet (25') pursuant to Section 14.1102.C of Article XI of Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA 32-V-87) before the Zoning Board of Appeals of the Village of Mount Prospect on the 21st day of May, 1987, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 6th day of May, 1987; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect to deny the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.606 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.1102.C of Article XI of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of single-family homes on lots 10-12, 16-18, 21-23, 29-31, 34-38, 43-46, 49-53, 58-60, 64-44, 68-72, 74, 77 and 79-96 with a maximum Floor Area Ratio of .365 and a ten foot (10') setback from the rear property line for a deck or patio on lots 2-7, 12-16, 24-28, 39-42, 54-56, 67, 68 and 74-77. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and age 2 ZBA 32-V-87 Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
