PROSPECT MANOR IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES THE 19th DAY OF May , 1987. Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 20th day of May , 1987. ORDINANCE NO. 3784 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 314 N. PROSPECT MANOR IN T~E VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Nick Nickolas has filed an application for variation with respect to property commonly known as 314 N Prospect Manor in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 4 in block 11 in Prospect Manor, being a subdivision of the South 3/4 of the West 1/2 of the West 1/2 of Section 34, Township 42 North, Range 11, East of the Third Principal Meridian in Cook County, Illinois and WHEREAS, Petitioner seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a addition to the principal structure (16'X20') to be four feet six inches (4'6") from a principal structure on the Subject Property, within a zoning district otherwise requiring ten feet (10') of separation structure pursuant to Section 14.102.B.2 of Article I of Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA 15-V-87) before the Zoning Board of Appeals of the Village of Mount Prospect on the 23rd day of April, 1987, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 6th day of April, 1987; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.606 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board 6f Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.102.B.2 of Article I of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow an accessory building to be four feet six inches (4'6") from a prinicpal structure subject to the following conditions: There shall be no openings included in the room addition within 10 feet of the existing garage. 2. Drywall shall be placed on the inside garage walls age 2 ZBA 15-V-87 adjacent to the addition and within 10 feet thereof. Drywall of the room addition walls adjacent to the garage shall be of 5/8" minimum width. If and when the garage is replaced, it shall be located in accordance with the Village Code. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property.' SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
