Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 5th day of November , 1987. RDINANCE NO. 3865 AN ORDINANCE PROHIBITING ENCROACHMENTS WITHIN THE STATE OF ILLINOIS RIGHT-OF-WAY ALONG U.S.ROUTE 12 (RAND ROAD) AT KENSINGTON ROAD IN THE VILLAGE OF MOUNT PROSPECT WHEREAS, the State of Illinois, acting by and through its Department of Transportation, is desirous of improving the U.S. Route 12 at Kensington Road in the Village of Mount Prospect; and WHEREAS, said project is being constructed in order ~o facilitate the free flow of traffic and ensure safety to the motoring public; and WHEREAS, a portion of the project runs through the Village of Mount Prospect; and NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: No person, firm, corporation or other entity shall install, place, maintain or construct any structure that encroaches upon the State of Illinois right-of-way on the limits of the.improvement being the subject of this Ordinance within the Village of Mount Prospect. SECTION TWO: The Village Clerk of the Village of Mount Prospect is authorized and directed to attach a copy of this Ordinance to the Agreement dated ~0U~ ~ , 1987, by and between the State of Illinois and the Village of Mount Prospect, relative to the improvement being the subject of this Ordinance. SECTION THREE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
