Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 5th day of November , 1987. ORDINANCE NO. 3862 AN ORDINANCE GRANTING VARIATIONS FOR CERTAIN PROPERTY COMMONLY KNOWN AS 1110 OAKWOOD IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Hatim Poonwalla, has filed an application for variation with respect to property commonly known as 1110 Oakwood in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot Seven Hundred Eleven (711) in Elk Ridge Villa - Unit No. 8 being a subdivision of all of Lot 7 and parts of Lots 5 and 6 in the division of Louis F. Busse Farm, being a subdivision of part of the Northeast 1/4 of Section 15, Township 41 North, Range 11, East of the Third Principal Meridian in Cook County, Illinois; and WHEREAS, Petitioner seeks variations from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the continuation of a deck structure built on the Subject Property which deck structure encroaches to within zero feet (0') of the rear property line instead of the required 25 feet; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA 67-V-87) before the Zoning Board of Appeals of the Village of Mount Prospect on the 24th day of September, 1987, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 9th day of September, 1987; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.606 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variations requested with respect to Section 14.1202.B.1 of Article XII and Section 14.1202.C Article XII of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the continuation of a deck structure built on the Subject Property which deck structure encroaches to within zero feet (0') from the rear property line, in accordance with Exhibit "A" attached hereto and hereby made a part hereof, subject to removal of one eight foot (8') section of the deck along the south property line so said deck structure would be nine feet (9') from the property line and with dimensions of fourteen feet (14') by thirty-two feet (32'). age 2 ZBA 67-V-87 SECTION THREE: The deck structure shall be modified to provide for adequate structural integrity and shall comply with all building codes and fire safety requirements in accordance with the Village Code in effect the date of this Ordinance. SECTION FOUR: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, apDroval and publication in pamphlet form in the manner provided by law.
