ORDINANCE NO. 3854 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 1813 THORNWOOD IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, John Antonucci has filed an application for variation with respect to property commonly known as 1813 Thornwood in the Village of Mount Prospect, Illinois (hereinafter referred to as the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 591 in Elk Ridge Villa, Unit No. 7, being a subdivision of part of Lot 5 in Division of the Louis F. Busse Farm, being a subdivision of part of the Northeast 1/4 of Section 15, Township 41 North, Range 11, East of the Third Principal Meridian, Cook County, Illinois; and WHEREAS, Petitioner seeks a variation from the following provisions of Chapter 14, Section 14.1202 of the Village Code of Mount Prospect, Illinois, to allow a wooden deck over an existing patio to be located sixteen feet (16') from the rear property line instead of the required twenty-five feet (25'); and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA 66-V-87) before the Zoning Board of Appeals of the Village of Mount Prospect on the 10th day of September, 1987, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 26th day of August, 1987; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the requested variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.1202 Article XII of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the a wooden deck in a portion of the required rear yard resulting in a sixteen foot (16') rear yard instead of the required 25 feet, as shown on Exhibit "A" attached hereto and hereby made a part hereof. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. BA 66-V-8/ Page 2 of 2 SECTION FOUR: In accordance with the provisions of Section 14.604 this variation shall be null and void unless permits are issued and construction begins within one (1) year of the passage of this Ordinance. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
