Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 21st day of October , 1987. ORDINANCE NO. 3853 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 2022 WOODVIEW IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Ted Smoczynski has filed an application for variation with respect to property commonly known as 2022 Woodview in the Village of Mount Prospect, Illinois (hereinafter referrd to as the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 521 in Woodview Manor Unit No. 4 being a subdivison of part of the Southeast Quarter of Section 24, Township 42 North, Range 11, East of the Third Principal Meridian, Cook County, Illinois; and WHEREAS, Petitioner seeks a variation from the following provisions of Chapter 14, Section 14.1102.C of the Village Code of Mount Prospect, Illinois, to allow a wooden deck to be located 12 feet from the rear property line instead of the required 25 feet; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA 64-V-87) before the Zoning Board of Appeals of the Village of Mount Prospect on the 10th day of September, 1987, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 26th day of August, 1987; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the requested variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.1102.C Article XI of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the a wooden deck in a portion of the required rear yard resulting in a twelve foot (12') rear yard instead of the required twenty-five feet (25'), as shown on Exhibit "A" attached hereto and hereby made a part hereof. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. BA 64-V-8, ~ Page 2 of 2 SECTION FOUR: In accordance with the provisions of Section 14.604 this variation shall be null and void unless permits are issued and construction begins within one (1) year of the passage of this Ordinance. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
