AN ORDINANCE GRANTING A SPECIAL USE FOR CERTAIN PROPERTY COMMONLY KNOWN AS 199 WEST RAND ROAD IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, the Petitioner~ TWIN LINKS, has filed an application for variation with respect to property commonly known as 199 West Rand Road in the Village of Mount Prospect, Illinois (hereinafter referred to as the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot A in Bartmann 199 Rand Subdivision, a Subdivision of part of the East 1/2 of the Southwest 1/4 of Section 27, Township 42 North, Range 11, East of the Third Principal Meridian, Recorded on April 18, 1985 as Document Number 27516851 in the Recorder's Office of Cook County, Illinois; and WHEREAS, Petitioner seeks a special use to allow batting cages facilities in conjunction with the existing miniature golf courses and batting cages; and WHEREAS, a public hearing was held on the rezoning request (designated as Case No. ZBA-58-SU-86) before the Zoning Board of Appeals of the Village of Mount Prospect on the 10th day of September, 1987, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 26th day of August, 1987; and WHEREAS, the Zoning Board of Appeals has reviewed the request for a Special Use for batting cages and miniature golf courses; and WHEREAS, the President and Board of Trustees have given further consideration to the Special Use request and have determined that the same satisfies the standards set forth in Section 14.704 of Article VII regarding the Special Use of said Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for Special Use provided that same is accomplished pursuant to the conditions hereinafter set forth. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President Board of Trustees of the Village of Mount Prospect. and SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a Special Use for the operation of batting cage facilities. BA 58-SU-87 Page 2 of 2 SECTION THREE: The subject Special Use shall be granted upon the following conditions: (1) The batting cages being the subject of this request shall be built in accordance with the site plan attached as Exhibit "A". (2) A landscaping plan must be submitted and the Planning and Zoning Department prior being issued and plant material shall be prior to occupancy. approved by to permits installed SECTION FOUR: With the Exception for the variations granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
