ORDINANCE NO. 3842 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 913 COUNTRY LANE IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, George Cutro has filed an application for variation with respect to property commonly known as 913 Country Lane in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot ~94 of County Club Terrace, a Subdivision of part of lot 16 and part of Lot 18 in the owner's Subdivision of Section 13, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois; and WHEREAS, Petitioner seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a driveway to be built on the Subject Property with a width of twenty seven feet (27'), within a zoning district otherwise requiring a maximum width of eighteen feet (18') pursuant to Section 14.116.C of Article I of Chapter 14 and a parking pad nine feet (9') in width and twenty- two feet (22') in length adjacent to the attached garage and located in apart of the required front yard (Section 14.1102); and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA 61-V-87) before the Zoning Board of Appeals of the Village of Mount Prospect on the 27th day of August, 1987, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 12th day of August, 1987; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.606 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.116.C of Article I of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a driveway to be a total width of twenty seven feet (27') and a parking pad as stated above and in accordance with the attached landscape and site plan. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and age 2 ZBA 61-V-87 Regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: In accordance with the provisions of Section 14.604 this variation shall be null and void unless permits are issued and construction begins within one (1) year of the passage of this Ordinance. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
