ORDINANCE NO. 3841 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 1500 S BUSSE ROAD IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, St. John's Apartments has filed an application for variation with respect to property commonly known as 1500 S Busse Road in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: The east 582 as measured at right angles to the east line thereof of that part of Lot 2, in Edward Busse's Division of part of the southeast quarter of Section 15, and the northeast quarter of Section 22, Township 41 North, Range 11, East of the thrid Principal Meridian, as per plat recorded in the Recorder's Office if Cook County, Illinois, Decemeber 17, 1919 as Document Number 6696216, lying south of the north 759.54 feet thereof, as measured on the east and west lines of Lot 2, and lying northerly of a line drawn from a point on the west of the east half (1/2) of the southeast quarter of said section 15, 335.56 feet southeast north of the southwest corner of said east half (1/2) of the southeast quarter (1/4) to a point on the east line of said Lot 2, 539.80 feet north of the south line of said Section 15, (as measured along the east line of said Lot 2), in Cook County, Illinois; and WHEREAS, Petitioner seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a expanded parking area to be built on the Subject Property to allow a zero foot (0') rear yard setback, within a zoning district otherwise requiring a rear yard setback of twenty feet (20') pursuant to Section 14.1503.C of Article XV of Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA 60-V-87) before the Zoning Board of Appeals of the Village of Mount Prospect on the 27th day of August, 1987, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 12th day of August, 1987; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.606 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDEt~i~AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President Board of Trustees of the Village of Mount Prospect. and age 2 ZBA 60-V-87 SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.1503.C of Article XV of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of an expanded parking area by twenty (20) spaces allowing a zero foot (0') rear yard setback to be constructed in accordance with the site plan attached hereto. SECTION THREE: The parking area shall provide for twelve (12) spaces, it shall be landscaped and the dumpsters shall be enclosed, all subject to the approval of the Planning and Zoning Department. SECTION FOUR: Except for the variation granted herein, all other applicable Village of Mount'Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION FIVE: In accordance with the provisions of Section 14.604 this variation shall be null and void unless permits are issued and construction begins within one (1) year of the passage of this Ordinance. SECTION SIX: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
