ORDINANCE NO. 3893 AN ORDINANCE TO AMEND ARTICLE V ENTITLED "METERS AND RATES" OF CHAPTER 22 OF THE VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: Article V entitled "Meters and Rates" of Chapter 22 of the Village Code of Mount Prospect, Illinois, is hereby amended as follows: (A) follows: BY amending Subsection A, B, and C of Section 22.504.2 to read as A. All Village users within the Village, having a direct or indirect connection with Village water mains or pipes shall pay the following rates: Water Rate For each 1,000 gallons of water consumed or portion thereof $2.10 B. All Village users outside the corporate limits of the Village having a direct or indirect connection with Village water mains or pipes shall pay the following rates: Water Rate For each 1,000 gallons consumed or portion thereof $4.20 C. All Village users located outside the boundaries of Specfal Service Area No. Five shall pay an additional monthly availability charge based upon the size of the water meter as follows: 5/8" meter $ 9.00 3/4" meter 13.75 1" meter 25.00 1-1/2" meter 38.50 2" meter 79.00 3" meter 136.00 4" meter 230.00 6" meter 435.00 8" meter 900.00 (B) By amending Subsection C of Section 22.504.3 to read: C. Rate All Village sewer users within the corporate limits of the Village, having a direct or indirect connection with the Village sewer and water mains or pipes shall pay the following sewer rate, based upon the amount of water consumed to which sewer service is furnished: Per 1,000 gallons of water consumed or portion thereof $0.20 All Village sewer users within the corporate limits of the Village having a direct or indirect connection with the Village sewer mains or pipes and not with the Village water ~ains or pipes, shall pay a flat rate of one dollar forty cents ($1.40) per month per dwelling unit. All sewer users outside the corporate limits of the Village having a direct or indirect connection with the Village sewer and water mains or pipes, shall pay the following sewer rate based upon the amount of water consumed to which sewer service is funished: Per 1,000 gallons of water consumed or portion thereof $0.40 All sewer users outside the corporate limits of the Viilage having a direct or indirect connection with the Viiiage sewer mains or pipes, but not with Viiiage water mains or pipes, shaii pay a flat rate of two dollars eighty cents ($2.80) per month per dwelling unit. (C) By changing paragraph 5 of Subsection C of 22.504.3 to paragraph 10. (D) By adding paragraph 5 to Subsection C of 22.504.3 to read: All Village sewer users Within the corporate limits of the Village and within the limits of the district formerly known as Prospect Meadows Sanitary District as further listed in Section 22.510(A) having a direct or indirect connection with the Village sewer and water mains or pipes shall pay the following sewer surcharge based upon the amount of water consumed to which sewer service is furnished. Honthly fee of $9.00 and for each 1,000 gallons consumed or portion thereof in excess of 10,000 gallons per month $0.70 (E) By adding paragraph 6 to Subsection C of 22.504.3 to read: All sewer users within the corporate limits of the Village and within the limits of the district formerly known as Prospect Neadows Sanitary District and as further listed in Section 22.510(B) having a direct or indirect connection with the Village sewer mains or pipes and not with the Village water mains or pipes, shall pay the following sewer surcharge: Honthly fee of $15.00 for residential property and $45.00 for commercial property (F) By adding paragraph 7 to Subsection C of 22.504.3 to read: 7. All sewer users outside the corporate limits of the Village and within the limits of the district formerly known as Prospect Headows Sanitary District and as further listed in Section 22.510(C) having a direct or indirect connection with the Village sewer and water mains or pipes shall pay the following sewer surcharge: Monthly fee of $30.00 for residential property and $90.00 for commercial property, provided that the total annual sewer surcharge for any such commercial property shall not exceed $540.00 if total water used during any calendar year does not exceed 360,000 gallons. (G) By adding paragraph 8 to Subsection C of 25.504.3 to read: The total of all sewer surcharge revenue billed in accordance with paragraphs 6, 7, and 8 of this Subsection C of 22.504.3 during any month shall be accounted for separately and shall be used to amortize the cost of certain sewer repairs totaling $275,000 at an annual interest rate of 7.25% until such time aS the $275,000 plus interest is paid. (H) By adding paragraph 9 to Subsection C of 25.504.3 to read: The sewer surcharge fees identified in paragraphs 7, 8, and 9 of this Subsection C of 22.504.3 shall terminate when the cost of certain repairs totaling $275,000 plus interest at 7.25% has been paid. 2 (I) By amending 22.506.1 to read: Late Payment Penalty; Service Shut Off. All water and sewer charges shall be due and payable on or before the twenty first day after the date of the statement for such charges. All bills unpaid after the twenty one (21) day period provided for shall become delinquent and a penalty of ten percent (10,%) of the total amount of such charges shall be added thereto and shall be due in addition to the charges for such services. Whenever charges for water serv£ce have remained unpaid for more than sixty days from the date of the statement provided for, the water service may be shut off from the premises of such delinquent consumer, provided that the consumer shall be given at least ten (10) days' written notice of intent to shut off such services, and the reason therefor, and an opportunity to request and obtain a hearing with respect to such unpaid charges before the Finance Directr which, if adverse, shall further allow the consumer a reasonable period of time, not less than five (5) days, to pay the delinquent charges prior to th~ shut off services. Water service which has been shut off shall not be resumed until all bills in arrears shall have been paid, including fifty dollars ($50.00) for exenses incurred in shutting off and turning on the water. It shall be the duty of the Director of Finance to enforce the provisions of this Section whenever delinquency shall occur. (3) By adding Section 22.510 to read: Village sewer users within the corporate limits of the Village and within the district formerly known as Rrospect Meadows Sanitary District subject to the surcharge identified in Section 22.504.3(C) paragraph 5 are listed below: ' 1. 600 W. That property located at the Northwest Corner of the intersection of Rand Road and Euclid Avenue. SECTION TWO: The water and sewer rates established by Section One of this Ordinance shall be effective for billings subsequent to April 30, 1988. SECTION THREE: Article V entitled "Meters and Rates" of Chapter 22 of the Village Code of Mount Rrospect, Illinois, shall hereafter be amended as follows: (A) BY hereafter amending Subsection A, B, and C of Section 22.504.2 to read as follows: A. All Village users within the Village, having a direct or indirect connection with Village water mains or pipes shall pay the following rates: Water Rate For each 1,000 gallons of water consumed or portion thereof $2.28 B. All Village users outside the corporate limits of the Village having a direct or indirect connection with Village water mains or pipes shall pay the following rates: Water Rate For each 1,000 gallons consumed or portion thereof $4.56 C. All Village usefs located outside the boundaries of Special Service Area No. Five shall pay an additional monthly availability charge based upon the size of the water meter as follows: 5/8" meter $ 10.00 3/4" meter 15.00 1" meter 27.50 1-1/2" meter 42.50 2" meter 87.00 3" meter 150.00 4" meter 250.00 6" meter 475.00 8" meter 990.00 (B) By hereafter amending Subsection C of Section 22.504.3 to read: C. Rate · 1. All Village sewer users within the corporate limits of the Village, having a direct or indirect connection with the Village sewer and water mains or pipes shall pay the following sawer rate, based upon the amount of water consumed to which sewer service is furnished: Per 1,000 gallons of water consumed or portion thereof $0.22 6 ll Village sewer users within the corporate limits of the Village having a direct or indirect connection with the Village sewer mains or pipes and not with the Village water mains or pipes, shall pay a flat rate of one dollar fifty five cents ($1.55) per month per dwelling unit. All sewer users outside the corporate limits of the Village having a direct or indirect connection with the Village sewer and water mains or pipes, shall pay the following sewer rate based upon the amount of water consumed to which sewer service is funished: Per 1,000 gallons of water consumed or portion thereof $0.44 All sewer users outside the corporate limits of the Village having a direct or indirect connection with the Village sewer mains or pipes, but not with Village water mains or pipes, shall pay a flat rate of two dollars eighty cents ($2.80) per month per dwelling unit. SECTION FOUR: The water and sewer rates established by Section Three of this Ordinance shall be effective for billings subsequent to April 30, 1989. SECTION FIVE: This Ordinance shall be'in full force and effect upon its passage, approval, and publication in pamphlet form in accordance with law.
