Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 20th day of January , 1988. ORDINANCE NO. 3890 AN ORDINANCE GRANTING A SPECIAL USE FOR THE PROPERTY COMMONLY KNOW/q AS MOUNT PROSPECT PLAZA IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAs, Walgreen Company has filed a petition for a special use with respect to the property commonly known as Mount Prospect Plaza, in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Attached EXHIBIT "A" WHEREAS, Petitioner seeks a special use to allow three satellite antennas on the Subject Property in accordance with Section 14.2001.C.5 of Article XX of Chapter 14 of the Village Code of Mount Prospect, Illinois; and WHEREAS, a pub!ic hearing was held on the variation request (designated as Case No. ZBA 86-SU-87) before the Zoning Board of Appeals in the Village of Mount Prospect on the 10th day of December, 1987, and the 17th day of December, 1987, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 24th day of December, 1987; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations in favor of the proposed special use subject to certain conditions to the President and Board of Trustees of the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees have given further consideration to the said request and have determined that the same meets the standards set forth in Section 14.704 of Article VII pertaining to special use of said Chapter 14 of the Village Code and have further determined that the granting of the proposed special use would be in the best interest of the public, provided the same are accomplished pursuant to the conditions hereinafter set forth. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village Of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a special use to allow three satellite antennas; two with a maximum diameter of six feet (6') and maximum height of ten feet (10') and one with a maximum diameter of twenty one feet (21') and a maximum height of twenty four feet two inches (24'2") on the Subject Property. age 2 ZBA 86-SU-87 SECTION THREE: The installation of the dishes shall be ~n conformance with the Exhibits attached hereto including a screen wall along the East and North edges of the satellite installation which shall be constructed of materials compatible with the existing building. SECTION FOUR: The Walgreen Company shall be responsible for installing all landscape plant material, parking lot islands, and foundation screening treatment subject to the approval of the Planning and Zoning Department and subject to the approval of the property owner. SECTION FIVE: With the exception of the special use granted herein, the Subject Property shall comply with all other applicable Village of Mount Prospect Ordinances and Regulations pertaining thereto. SECTION SIX: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
