Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 20th day of January , 1988. ORDINANCE NO. AN ORDINANCE TO AMEND CHAPTER 14 ENTITLED "ZONING" OF THE VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS TO PROVIDE FOR CERTAIN CHANGES TO THE ZONING CODE WHEREAS, Walgreens Company has proposed amendments to the Zoning Ordinance to provide for changes to establish new regulations for satellite antenna installations in the B-3 Business District; and WHEREAS, a public hearing was held on said amendments, designated as Case No. ZBA 85-A-87 before the Zoning Board of Appeals of the Village of Mount Prospect on the 10th day of December, 1987 and the 17th day of December, 1987 pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 24th day of November, 1987; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the Board of Trustees of the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees have considered further the amendments and the findings and recommendations of the Zoning Board of Appeals and have determined that it is in the best interest of the community to grant the amendment request. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: Chapter 14 entitled "Zoning" of the Village Code of Mount Prospect, Illinois, 1981, as amended, is hereby further amended by deleting Section 14.2001.C.5 of Article XX, and substituting therefore the following so that Section 14.2001.C.5 of Article XX shall hereinafter read as follows: "Section 14.2001.C.5. Satellite antennas with a diameter exceeding forty inches (40"), subject to the following: aw The maximum diameter of a dish shall not exceed thirty feet (30'). Ail ground mounted antennas (including pole-mounted antennas) shall not exceed the height of the buildings to which they are accessory. Ce Ail non-ground mounted antennas (including roof and wall mounted antennas): shall be located on the roof or on the rear or side of the building to which they are accessory; shall have a maximum diameter of one-third of the height of the building to which they are accessory; and shall have a maximum height as allowed in Section 14.2002.A.2. d. Ail satellite antenna installations: (1) shall be located outside any required yard and shall be a minimum of twenty feet (20') from any property line; (2) shall have an overall size and height which age 2 ZBA 85-A-87 are in proportion with the scale of the building to which they are accessory; and (3) shall be fully screened from view from adjacent roadways and properties (from grade level) with materials which are compatible with the building to which they are accessory. Ground-mounted satellite antennas shall be landscaped in a manner which enhances the visual impact of the installation. The area of a satellite antenna installation, including screening materials, shall be included within the floor area of the building to which it is accessory for purposes of calculating maximum land coverage and floor area ratio, but not for purposes of calculating the required number of parking spaces." SECTION TWO: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
