Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 20th day of January ., 1988. ORDINANCE NO. 3887 AN ORDINANCE TO ENLARGE THE BOUNDARIES OF SPECIAL SERVICE AREA NO. 5 IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, pursuant to Ordinance No. 3284 adopted on November 30, 1982 there was established in this Village, Special Service Area No. 5 for the purpose of providing necessary funding for a portion of the Village's cost of constructing and installing necessary water distribution mains and pumping stations in order to transport and provide Lake Michigan Water to the territory contained within said Special Service Area; and WHEREAS, subsequent to the adoption of Ordinance No. 3284 and the establishment of Special Service Area No. 5, additional territory has been annexed to the Village, which territory (as hereinafter described in the legal description attached hereto as Exhibit A and made a part of this Ordinance by reference) will be obtaining its water supply within the Village from Lake Michigan water through the distribution mains and pumping stations constructed pursuant to funding under Special Service Area No. 5; and WHEREAS, this Board did adopt Ordinance No. 3843 on October 6, 1987 proposing to enlarge the boundaries of Special Service Area No. 5, within the Village by adding thereto the said territory so described; and WHEREAS, on the 19th day of October , 1987, publication was made an'd notice mailed to the owners of the territory proposed to be added to Special Service Area No. 5, that a public hearing would be conducted by the Village to consider the enlargement of the boundaries of Special Service Area No. 5 by the addition of the territory herein described; and WHEREAS, the President and Board of Trustees duly held a Public hearing on November 4, 1987 for the purpose of considering the enlargement of the boundaries of Special Service Area No. 5 by the addition of the territory herein described; and WHEREAS, for a period of sixty (60) days following the final adjournment of said Public hearing not petition was filed with this Village objecting to the proposed enlargement of the boundaries of Special Service Area No. 5; and WHEREAS, all of the territory sought to be included herein within the boundaries of Special Service Area No. 5 is contiguous to the present boundaries of Special Service Area No. 5 and within the corporate limits of the Village of Mount Prospect and will benefit specially from the municipal services to be provided; which services are unique and are in addition to municipal services provided by the Village of Mount Prospect as a whole; and WHEREAS, this Board deems it to be in the best interest of the Village of Mount Prospect that the boundaries of Special Service Area No. 5 be so enlarged to include therein the territory herein made a part of this Ordinance by reference. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: This Board does hereby incorporate as findings of fact by the President and Board of Trustees of the Village of Mount Prospect the recitals hereinabove set forth. SECTION TWO: There shall hereby be added to the boundaries of Special Service Area No. 5 the territory legally described and set forth in the attached Exhibit A which is made a part of this Ordinance by reference; all of which territory is contained within the oundaries of Special Service Area No. 5 SECTION THREE: That territory hereby added to this Special Service Area No. 5 shall receive the special municipal services to the Special Service Area including, but not limited to municipal services consisting of the construction and installation of the necessary water distribution mains and pumping stations to provide Lake Michigan water to the Special Service Area, and shall assume and pay its proportionate portion of the cost of said special services for which general obligation bonds have previously been issued by this Village. SECTION FOUR: An accurate map of the territory being added to Special Service Area No. 5 is attached hereto and is also made of this Ordinance by reference. a part SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
