ORDINANCE NO. 3885 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 747 S. MEIER ROAD IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Stowe Allen has filed an application for variation with respect to property commonly known as 747 S. Meier Rd in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 1 and Lot 2 in Allen's ReSubdivision of a part of Lot 4 in Meier Borthers Subdivision, in the southeast 1/4 of Section~10, Township 41 North, Range 11, East of the Third Principal Meridian, in the Village of Mount Prospect, Cook County, Illinois; and WHEREAS, Petitioner seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a single family detached dwelling to be built on the Subject Property with a smaller lot width and a smaller rear yard, within a zoning district otherwise requiring a sixty-five foot (65') lot width and a twenty-five foot (25') rear Ward pursuant to Section 14.1101.A.1 and 14.1102.C of Article XI of Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA 70-V-87) before the Zoning Board of Appeals of the Village of Mount Prospect on the 29th day of October, 1987, pursuant to due and proPer notice thereof published in the Mount Prospect Herald on the 8th day of October, 1987; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.606 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of,the Village to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President Board of Trustees of the Village of Mount Prospect. and SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.1101.A.1 of Article XI of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow a twenty-one feet six inches (21'6") lot width for Lot 4 instead of the required sixty-five foot (65') lot width. SECTION THREE: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.1102.C of Article XI of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow a six foot four inch (6'4") rear yard along the South property line of Lot 4 instead of a twenty-five foot (25') rear yard. age 2 ZBA 70-V-87 SECTION FOUR: The variations granted herein shall be conditioned upon the development of the property in conformance with the Meir-Meadow Resubdivision Plat and that the minimum setback of a principal structure on Lot 4 shall be six feet four inches (6'4") from the North property line and twenty-five feet (25') from the South property line. SECTION FIVE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain in full force and effect as to the Subject Property. SECTION SIX: In accordance with the provisions of Section 14.604 this variation shall be null and void unless permits are issued and construction begins within one (1) year of the passage of this Ordinance. SECTION SEVEN: This Ordinance shall be in full force and effect ~rom and after its passage, approval and publication in pamphlet form in the manner provided by law.
