ORDINANCE NO. 3931 AN ORDINANCE AMENDING SPECIFIED SECTIONS OF THE VILLAGE CODE OF MOUNT PROSPECT BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTYt ILLINOIS: SECTION ONE~ That Article III of Chapter 4 entitled "Department of Community Development" of the Village Code of Mount Prospect, as amended, is hereby further amended by changing the name of the Department to "Department of Planning and Zoning"; so that hereinafter, said Article III of Chapter 4 shall be known as "Department of Planning and Zoning". Wherever the title 'Department of Community Development' appears throughout the Village Code it shall be changed to read "Department of Planning and Zoning". SECTION TWO: That Article IV of Chapter 4 entitled "Department of Public Works" of the Village Code of Mount Prospect, as amended, is hereby further amended by deleting therefrom Section 4.403 in its entirety. SECTION THREE: That Article V of Chapter 4 entitled "Department of Management Services" of the Village Code of Mount Prospect, as amended, is hereby further amended by changing the name of the Department to "Finance Department" Ail references thereto throughout the Village Code to 'Department of Management Service~ shall be changed to read "Finance Department". SECTION FOUR: That Sections 4.901, 4.902, 4.903, and 4.904 of Article IX of Chapter 4 of the Village Code of Mount Prospect, as amended, is hereby further amended by deleting said Sections and substituting therefor the following; so that hereinafter said Sections 4.901, 4.902, 4.903 and 4.904 shall be and read as follows: "Sec. 4.901. Creation of Department; Appointment Am There is hereby established a Fire Department of the Village, which shall be under the jurisdiction and control of the Village Manager. 1. The head of said Department shall ~e the Fire Chief who shall be appointed by the Village Manager for an indefinite period of time. 2. The Fire Chief is hereby authorized to appoint, from within or outside of the Mount Prospect Fire Department, with the advice and consent of the Village Manager, two (2) Deputy Fire Chiefs, and four (4) Captain-Shift Commanders; which positions shall be known as "exempt rank" positions. If a member of the Fire Department is appolnt to an exempt rank prior to being eligible to retire, he shall be considered as on furlough from the rank he held at the time of his appointment. a. The Village Manager is hereby authorized to suspend or discharge the Fire Chief. b. The Fire Chief, with the advice and consent of the Village Manager, is hereby authorized to suspend or discharge any or all of the persons holding the positions of Deputy Fire Chief, and/or Captain-Shift Commander. c. In the event of the suspension or discharge of any of the persons holding the position of Fire Chief, Deputy Fire Chief and/or Captain-Shift Commander or such person resigns therefrom prior to retirement, said person or persons shall revert to his or her permanent rank, if any, in the Department as established under the Illinois Board of Fire and Police Commissioners Act. Amend Chapter 2 Page 2 of 4 Ail of the personnel of the said Fire Department shall encompass such members in Fire and Police Commission rank and number as may be provided from time to time in the annual budget and the tax levy ordinance adopted by the President and Board of Trustees. The power of appointment, discharge or suspension of all officers of the Fire Department, other than the Chief, Deputy Chief and Caption-Shift Commander established hereinabove, shall lie with the Board of Ft~e and Police Commissioners of the Village heretofore created and now acting pursuant to the provisions of the Illinois Municipal Code. Ce The said Department shall also encompass such members of exempt rank, clerical assistance, fire assistants and other employees the number of which the President and Board of Trustees shall provide from time to time in the annual budget and tax levy ordinance. Sec. 4.902. Bureau of Fire Prevention A® In addition to directing the regular and vplunteer Fire Department of the Village, the Fire Chief shall serve ex-officio as the Chief of the Bureau of Fire Prevention of the Fire Department. 1. The Bureau of Fire Prevention shall consist of a Deputy Fire Chief and other civ£11an members, as well as such sworn Fire Department personnel as may be appointed by the Chief for the purpose of administering and enforcing the regulations of the Village Code relating to fire prevention and fire safety. Sec. 4.903. Fire Chief; Duties. In addition to the duties and responsibilities provided in this Article, the Fire Chief shall have such duties and responsibilities as are, from time to time, imposed by law or assigned by the Village Manager pursuant to Sections 4.103.K. and 4.103.L of this Chapter. Sec. 4.904. Chiefs shall be shall have such Deputy Fire Chiefs; Duties. The Deputy Fire second only in rank to the Fire Chief and duties as may be assigned by the Fire Chief." SECTION FIVE: That Article VII of Chapter 4 entitled "Department of Health Services" is hereby deleted in its entirety; so that hereinafter Article VII of Chapter 4 shall be "Reserved". SECTION SIX: That Article VI of Chapter 4 entitled "Reserved" of Chapter 4 of the Village Code is hereby amended by creating Amend Chapter Page 3 of the "Department of Insoection 'Services"; so hereinafter said Article VI shall be and read as follows: " ARTICLE VI DEPARTMENT OF INSPECTION SERVICES SECTION: 4.601 4.602 Creation of Department; Appointment Duties and Responsibilities Sec. 4.601. Creation of Department; Appointment. There is hereby established a Department of Inspection Services which shall be under the jurisdiction and control of the Village Manager. The head of said Department shall be the Director of Inspection Services, appointed by the Village Manager for an indefinite period time. Sec. 4.602. Duties and Responsibilities. The Director of Inspection Services shall have such duties and responsibilities as are from time to time imposed by law or assigned by the Village M~nager pursuant to the provisions of Article I of Chapter 4 of this Village Code of Mount Prospect, including but not limited to: ae The Director of Inspection Services and/or his authorized agents and representatives shall have the power to order all work stopped on construction or alterations and/or repairs to buildings within the corporate limits of the Village whenever such work is being done in violation of any of the provisions of any ordinance relating thereto including the building, zoning and development, property maintenance codes of the Village, as well as all other areas where referenced throughout the Village Code. ~ Be The Director of Inspection Services and/or his authorized age,ts and representatives, shall have the power, for the purposes of making inspections at any reasonable time, to make or cause to be made entry into any building or premises where work of altering, repairing and/or constructing any building or structure is commenced. The Director of Inspection Services shall also serve as Chief Electrical Inspector and, as such, shall also serve as Chairman of the Electrical Commission of the Village. 1. The Chief Electrical Inspector or his authorized agent shall enforce all of the ordinances of the Village relating to electricity, and shall supervise, Inspect and approve the installation of all electrical wires and apparatus. 2. Should any such electrical wires or apparatus be found unsafe to life or property, the Chief Electrical Inspector or his authorized agent or representative shall notify the person owning, using, installing or building such electrical device and Inform such person to place such wires and/or apparatus in a safe condition within a mend Chapter 4 Page 4 of E® reasonable time, not to exceed five (5) days after receipt of such notice. The Director of Inspection Services or his authorized agents or representatives shall be responsible for the operations of the Engineering Division. 1. The Engineering Division shall consist of a Village Engineer who shall have a degree~tn civil engineering from an accredited college or university, have practical experience in engineering and shall be licensed as a professional engineer pursuant to the applicable Statutes of the State of Illinois. 2. The Village Engineer will give technical advice and furnish professional engineering services to the Village in connection with planning, zoning and the execution and construction of public works and improvements. 3. The Village Engineer shall also perform such other duties as may be required of him from time to time by the Director of Inspection Services. The Director of Inspection Services or his authorized agent or representatives shall be responsible for the Health Inspector of the Village. 1. The Health Inspector shall be a registered sanitarian as prescribed ~n Chapter 111-1/2, Sections 551-572 of the Illinois Revised Statutes. 2. The Health Inspector shall have such duties and responsibilities as are, from time to t~me, imposed by law, th~s Village Code or assigned by the Director of Inspection Services. " SECTION SEVEN: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
