AN ORDINANCE GRANTING A SPECIAL USE FOR THE
PROPERTY COMMONLY KNOWN AS KINDER-CARE, INC.
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, Kinder-Care, Inc. has filed a petition for a special use
and variation with respect to the property commonly known as the
North side of Kensington opposite Russel Street, ~n the Village
of Mount Prospect, Illinois (they"Subject Property"); and
WHEREAS, the Subject Property ~s described as attached in Exhibit
"A"; and
WHEREAS, Petitioner seeks a special use to allow a special
use for day care center on the Sub3ect Property in accordance
with Section 14.1801.B.1 of Article XVIII of Chapter 14 of
the Village Code of Mount Prospect, Illinois; and
WHEREAS, a public hearing was held on the variation request
(designated as Case No. ZBA 11-SU-88) before the Zoning Board of
Appeals in the V~llage of Mount Prospect on the 25th day of
February, 1988, pursuant to due and proper not~ce thereof
published in the Mount Prospect Herald on the 8th day of February,
1988; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendations in favor of the proposed special use subject
to certain conditions to the President and Board of Trustees of
the Village of Mount Prospect; and
WHEREAS, the President and Board of Trustees have g~ven
further consideration to the said request and have determined
that the same meets the standards set forth ~n Section 14.704
of Article VII pertaining to special use of said Chapter 14
of the V~llage Code and have further determined that the
granting of the proposed special use would be in the best
interest of the public, provided the same are accomplished
pursuant to the conditions hereinafter set forth.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
AS FOLLOWS:
SECTION ONE: The recitals set forth hereinabove are incorporated
herein as findings of fact by the President and Board of Trustees
of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property a special
use to allow thereon on the Subject Property.
SECTION THREE: W~th the exception of the special use granted
herein, the Subject Property shall comply w~th all other
applicable Village of Mount Prospect Ordinances and Regulations
pertaining thereto.
SECTION FOUR: This Ordinance shall be ~n full force and effect
from and after its passage, approval and publication ~n pamphlet
form in the manner provided by law.
