RDINANCE NO. 3924
AN ORDINANCE AMENDING THE ZONING MAP WITH
RESPECT TO THE ZONING OF CERTAIN PROPERTY IN
A R-1 SINGLE-FAMILY RESIDENCE DISTRICT
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, Kinder-Care Inc., has filed an applacation to rezone
certain portions of property hereinafter described from a R-1
Single Family Residence District to a B-2 Business Dastrict as
provided in Article XXII of Chapter 14 of the Village Code of
Mount Prospect, Illanois; and
WHEREAS, the property is commonly known as North side of
Kensington opposite Russel Street in the V~llage of Mount
Prospect, Illinois (the "Subject Property"); and ~s legally
descrabed as attached as Exhibit "A"; and
WHEREAS, sa~d rezoning request is for the purpose of developang
a day care facility.
WHEREAS, a publac hearing was held on the varaat~on request
(designated as Case No. ZBA 10-Z-88) before the Zoning Board of
Appeals of the Village of Mount Prospect on the 25th day of
February, 1988, pursuant to due and proper not~ce thereof
published an the Mount Prospect Herald on the 8th day of
February, 1988; and
WHEREAS, the Zoning Board of Appeals has submitted its findangs
and recommendations to the President and Board of Trustees of the
Vallage of Mount Prospect to allow the requested rezoning; and
WHEREAS, th~s Board has considered the findings and
recommendations of the Zoning Board of Appeals and does hereby
determine at to be in the best interests of the Village to grant
the requested rezonang.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
AS FOLLOWS:
SECTION ONE: The recatals set forth hereanabove are
incorporated herein as fandings of fact by the Presadent and
Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The official zoning map pertaining to Chapter 14
entitled "Zoning" of the Village Code of Mount Prospect,
Illionis, as amended, is hereby further amended by reclassifyang
certain portaons of the R-1 Single Famaly District to a B-2
Busaness District, which is legally described as above.
SECTION THREE: Except for the changes stated herein all other
codes of the Village of Mount Prospect shall apply to the Subject
Property in their entirety.
SECTION FOUR: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
