ORDINANCE N0.3923 AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 117 W. LONNQUIST BLVD IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Ran]it Roy, has filed an application for variation with respect to property commonly known as 117 W. Lonnqulst Blvd. in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 1 in Chapman's resubdivision, being a resubdivis~on of lot 3 in Liljequist resubdiv~sion of that part of the North 227,17 feet of the West 335.00 feet of Lot 18 in Owner's subdivision of Section 13, Township 41 North, Range 11, East of the Third Principal Meridian, (except that part dedicated for W. Lonnqulst Blvd.) and also (except that part dedicated for S. Elmhurst Ave.) in Cook County, Illinois; and WHEREAS, Petitioner seeks a variation from the following provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a U shaped driveway to be built on the Subject Property utilizing forty-four percent (44%) of ~mpervious surface, within a zoning district otherwise requiring a maximum of one curb cut onto the pavement per driveway and an impervious surface of not more than thirty-five (35%) of the required front yard pursuant to Section 14.116.A and 14.1102.A of Article I and XI of Chapter 14; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA 7-V-88) before the Zoning Board of Appeals of the Village of Mount Prospect on the 28th day of January, 1988, and February 25, 1988 pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 11th day of January, 1988; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the V~llage of Mount Prospect to allow the requested variation, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.606 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the V~llage to grant the request for variation. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the V~llage of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property the variation requested with respect to Section 14.116.A and 14.1102.A of Article I and XI of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction a U shaped driveway with two curbs cuts onto the pavement as shown on Exhibit #1. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and Regulations shall remain an full'force and effect as to the Subject Property. age 2 ZBA 7-V-88 SECTION FOUR: In accordance with the provisions of Section 14.604 this variation shall be null and void unless permits are issued and construction begins w~thin one (1) year of the passage of this Ordinance. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
